AT&T-21STATE. and CLEC agree to carry out the FCC’s interim ISP terminating compensation plan on the date designated by AT&T-21STATE in a particular state without waiving and expressly reserving, all appellate rights to contest FCC, judicial, legislative, or other regulatory rulings regarding ISP-Bound traffic, including but not limited to, appeals of the FCC’s ISP Compensation Order. By agreeing to this Attachment, both Parties reserve the right to advocate their respective positions before courts, state or federal commissions, or legislative bodies.
