Common use of AS A RESULT OF DISABILITY Clause in Contracts

AS A RESULT OF DISABILITY. In the event that the Employee becomes disabled during the term hereof and, as a result, is unable to perform substantially all of his/her duties for the Company for more than one hundred and twenty (120) days during any period of three hundred and sixty-five (365) days, the Company may terminate the Employee's employment without further obligation upon notice to the Employee. In the event of such disability, the Employee will continue to receive his/her base salary and benefits under Sections 4 and 5 hereof until the earlier of the date the Employee becomes eligible for disability income under the Company's long-term disability or workers' compensation insurance plan or the date his/her employment terminates.

In the event that the Employee becomes disabled during the term hereof and, as a result, is unable to perform substantially all of his/her his duties for the Company and, if applicable, its subsidiaries and other affiliates, for more than one hundred and twenty (120) days during any period of three hundred and sixty-five (365) days, the Company may terminate the Employee's employment without further obligation upon notice to the Employee. In the event of such disability, the Employee will continue to receive his/her his base salary and benefits under Sections 4 and 5 hereof until the earlier of the date the Employee becomes eligible for disability income under the Company's long-term disability or workers' compensation insurance plan or the date his/her his employment terminates.

In the event of such disability, the Employee will continue to receive his/her base salary the Base Salary and benefits under Sections in accordance with Section 4 and 5 hereof until the earlier of (i) the date the Employee becomes eligible for disability income under the CompanyUST's long-term disability or workers' compensation insurance plan or (ii) the date his/her his employment terminates.
