ARTIST’S RIGHTS. A. The City shall provide and install, at the City’s expense, a plaque on or near the Artwork, containing a credit to the Artist and identifying the title of the Artwork. If requested by the Artist, the plaque shall also identify the fabricator of the Artwork. If the plaque is to be placed on the Artwork or on a pedestal holding the Artwork, placement should be made in consultation with the Artist. The City shall make efforts to maintain such plaque and notice in good repair.

ARTIST’S RIGHTS. ‌ The Artist may not be required to take part in the recording or broadcast. If the Artist agrees, the Engager shall contract the Artist in accordance with this Article and the Artist shall be free to negotiate above-scale compensation.
ARTIST’S RIGHTS. Subject to and consistent with the provisions of Article 4 above, Artist understands and agrees that they are, therefore, granted the following rights in the Work pursuant to this Agreement.
ARTIST’S RIGHTS. The Artist's rights under this Agreement shall be a revocable non-exclusive right to use the Site (“as is”), for the sole purpose identified in Exhibit “A” of this Agreement. The City's permission to Artist to use the Site in accordance with this Agreement shall not create any right, title, or interest in the Site. The Artist’s rights to use the Site in accordance with this Agreement shall be subject to any other property rights held by other parties. The City makes no representation or guaranty to the Artist regarding the extent of the City's property interest in the Site, relative to the rights of other parties to use the same Site, and relative to the Artist's proposed uses of the Site. In determining the Artist’s rights and responsibilities under this Agreement, the Artist shall take direction from the City Manager, the City’s Authorized Representative, and any of their authorized designees.
ARTIST’S RIGHTS. (a) If any alteration or damage to the Artwork occurs, the Artist shall have, as its sole and exclusive remedy, the right to disclaim authorship of the Artwork. Upon written request, with good cause shown regarding such alteration or damage, the District shall remove from the Artwork, any identification plaques, and all attributive references to the Artist at the District’s own expense within one hundred eighty (180) days following receipt of the written request. No provision of this Agreement shall obligate the District to alter or remove any such attributive reference printed or published prior to the District’s receipt of such written request.
ARTIST’S RIGHTS. 8.1 The City agrees to make all reasonable efforts to maintain the integrity of the Artwork, and will not knowingly make any use of the Artwork in a manner that would reflect unfavorably on Artist’s name or reputation.
ARTIST’S RIGHTS. The Artist retains all rights under the Copy right Act of 1976, 17 U.S.C. §101 et seq., as the sole author of the Artwork for the duration of the copyright.

ARTIST’S RIGHTS. The parties agree that the expertise and experience of Artist are material considerations for this Agreement. Except as may be specifically authorized under this Agreement, Artist shall not assign or transfer any interest in this Agreement nor the performance of any of Artist’s obligations hereunder, and any attempt by Artist to so assign this Agreement or any rights, duties or obligations arising hereunder shall be void and of no effect unless prior written consent is given by City and VTA. However, nothing in this section shall be deemed to prevent Artist, at Artist’s sole expense, from relying on or utilizing the services of such other consultant or contractor as Artist may require to assist Artist in the completion of the Artist’s Services.
ARTIST’S RIGHTS a. Copyright and Right to Credit. The Artist reserves all rights of reproduction and all copyrights in the Work, the preliminary design, and any incidental works made in the creation of the Work. The Project may use images of The Work in promotions/marketing of The Project.
