ARTICLE UNION RECOGNITION. The Employer or anyone authorized to act for it recognizes the Union as the sole collective bargaining agency as certified by the Labour Relations Board for the Province of Manitoba, for all its production employees excluding supervisors and those above the rank of supervisor, office and sales personnel, construction workers and those excluded by the Labour Relations Act and hereby consents and agrees to negotiate with the Union or any committee thereof in any and all matters affecting the relationship between the said employer and the employees who are members of the Union. Additionally, at the Employer's operation known as in the town of the Employer or anyone authorized to act for it recognizes the Union as the sole collective bargaining agency as certified by the Labour Relations Board for the Province of Manitoba, for all its employees excluding managers and those above the rank of manager, truck wash, Administrative Personnel, Chief Engineer and those excluded by the Labour Relations Act and hereby consents and agrees to negotiate with the Union or any committee thereof in any and all matters affecting the relationship between the said employer and the employees who are members of the Union. The Employer agrees to retain in its employ, within the bargaining unit, only members of the Union in good standing. The Employer shall be free to hire new employees who are not members of the Union, provided said non-members, whether part-time or full-time employees shall be eligible for membership in the Union, and shall make application within ten working days after employment and become members within thirty (30) working days. The Employer agrees to provide each new employee at the time of employment with a form letter outlining to the new employee his or her responsibility in regard to Union membership, and to provide the Union in writing with the name and address of each employee to whom they have presented the form letter, along with the employee's date of hire, the contents of the letter to be such that it is acceptable to the Employer. The Employer further agrees to provide the Chief Xxxxxxx of the Union, once a month, with a list containing names of all employees who have terminated their employment during the previous month. Once a month, the Chief Shop Xxxxxxx shall be notified by management regarding the rate of pay and department of each new employee.

ARTICLE UNION RECOGNITION. The Employer recognizes the Union as the sole bargaining agent of all employees of Cheshire Homes of London, Inc. in the municipality of London, save and except administrative office and clerical employees, supervisors and those above the rank of supervisor. The Employer agrees that it will not enter into any other agreement with employees either individually or collectively, which will conflict with any of the provisions of this Agreement. The Employer will supply the Union with a list of persons with supervisory and managerial authority over bargaining unit employees once each year, or within one month of any change. The parties recognize the mutual benefit of providing training opportunities to persons in the field of human services delivery. To this end the parties agree that the Employer may from time to time utilize trainees or students assigned through outside educational programs. When students and trainees are placed, they will not reduce the number of hours available to bargaining unit members and shall be accompanied by bargaining unit persons. For the purpose of this Article trainee is defined as an individual who is seeking non-paid practical retraining and work experience for a defined period of placement through a community support organization. Student is defined as an individual affiliated with an educational institution. Supervisors and all other persons whose jobs are not in the bargaining unit shall not perform bargaining unit work except in cases where a health and safety concern must be assessed, for training attendants, and for the purpose of familiarization if such training is to take place, and in emergency situations. One Union xxxxxxx shall be appointed from each program location. is agreed that stewards may take reasonable time from their work to attend to grievances, provided they first request permission from their immediate supervisor, and that such time as may be required is reduced to the minimum necessary. Such time off work shall be without loss of regular pay. ARTICLE UNION RECOGNITION. The Corporation recognizes the Amalgamated Transit Union, Local as the sole and exclusive bargaining agent for those employees occupying the positions or job classifications set forth in Schedules “A” and attached hereto, and forming part of this Agreement. Employees covered by this Agreement will maintain membership in good standing in Amalgamated Transit Union, Local and new employees, with the exception of temporary student help, will become members of the Union after completion of thirty (30) calendar days of employment. The Corporation will recognize a Union Negotiating Committee of not more than five (5) members, with a minimum of one (1) maintenance person to be part of the committee plus an International Representative. The Corporation will pay the Union Committee as per Clause of the Collective Agreement while in the process of re-negotiating a Collective Agreement.

ARTICLE UNION RECOGNITION. The Employer agrees to recognize the Canadian Union of Public Employees, Local as the sole and exclusive bargaining agent of all regular full-time and part-time employees in the bargaining unit of the Broadview Foundation in Metropolitan Toronto, at its Xxxxxxx Village division, save and except supervisors, persons above the rank of supervisor, professional medical staff, paramedical staff, office and clerical staff. Work of the Unit Employees whose jobs are not in the bargaining unit shall not perform the functions of jobs in the bargaining unit except in emergencies, in instances where employees in the bargaining unit are not immediately or for training purposes. The Supervisor will co-ordinate the timing of such meeting with the Union Executive member to ensure no disruption to ions.
ARTICLE UNION RECOGNITION. I The Employer recognizes the Union as exclusive bargaining agent for all employees of Co. (Canada) Inc., at Xxxxxx Street, Stoney Creek, Ontario, engaged in production work, save and except supervisors, instructors or trainers, maintenance personnel, quality resource personnel, per- sons above the rank of supervisor, and sales staff and anyone employed on a casual or part-time basis to perform work normally done by persons out- side of the bargaining unit. The Employer shall meet with no more than six (6) representatives of the employees as the Union may elect or appoint. A Union Representative, after first notifying the appropriate management representative, shall have the right to enter the work area of the plant during working hours for the purpose of investigating any grievance or complaint. A Union Representative performing such duties shall not interrupt or interfere with the plant operations. The local president and stewards shall, with the approval of the supervisor of the department in which she is employed, be permitted during regular working hours, without loss of pay, to leave her regular duties for a reasonable period of time to investigate grievances or complaints, which may include meetings. Union Committee Members will give reasonable notice of the need to leave their regular duties and permission by management will not be unrea- sonably withheld. Union members shall, with the prior approval of management, be permitted to perform union building functions within the bargaining unit, such as training, surveys, petitions, votes or clerical work. These activities shall be conducted before or after working hours and will not interfere with an employee’s ability to perform their job duties. The Union acknowledgesthat the local president and stewards have regularjob duties to perform on behalf of the Employer and will not absent themselves from those duties unreasonably in order to investigate and deal with grievances and complaints of employees.
