ARTICLE SCOPE AND RECOGNITION. The Employer recognizes the Union as the sole collective bargaining agent for its employees at Tendercare Nursing Homes Limited, as Tendercare Living Centre, Nursing Home in the Province of Ontario, save and except those employed as registered nurses, physiotherapists, occupational therapists, supervisors, foremen, persons above the rank of supervisor or xxxxxxx, staff, persons regularly employed for not more than twenty-four (24) hours per week, and students employed during the school vacation period. The Employer undertakes that he will not enter into any other agreement or contract with those employees for which the Union has bargaining rights either individually or collectively which will conflict with any of the provisions of this Agreement. Where the masculine pronoun is used in this Agreement, it shall mean and include the feminine pronoun where the context so applies. Where the singular pronoun is used it may be deemed to mean the plural, within the appropriate context. Any reference to doctor will include, where appropriate, nurse practitioner.

The Company recognizes the Union as the exclusive bargaining agent for all its employees at its retail store in save and except department supervisors, persons above the rank of department supervisor, security staff, management trainees, office and clerical staff, students employed on a co-operative program with a school, college or university. Persons not in the bargaining unit may perform any work assigned to them by management whether performed by bargaining unit members or otherwise. ARTICLE

ARTICLE SCOPE AND RECOGNITION. The Employer recognizes the Union as the sole and exclusive bargaining agency for all journeymen and apprentices of the Plumbing and Pipefitting Industry in the employ of the Employer on work within the boundaries of the Province of Manitoba with respect to wages, hours and other terms and conditions of employment on any and all work described in Article of this Agreement. The Union agrees, on the construction and service work, to work only for and supply men to Employers who agree to comply with the working rules and wage scales as set out in this Agreement, and are signatory thereto, or are of the National Agreement. The Employer agrees not to sublet or contract out any work covered by the United Association’s trade jurisdiction unless the Contractor to whom the work is sublet is under Agreement with Local the United Association, or one of its Local Unions. The Employer, when subletting or contracting out any work not covered by the United Association’s trade jurisdiction will endeavour to assign the above work to firms whose employees are in Unions affiliated with the

The Hospital recognizes t h e Union as the sole collective bargaining agency for a l l its employees at Cambridge, Ontario, save and except professional medical s t a f f , graduate nursing staff, undergraduate nurses, graduate pharmacists, graduate dietitians, student dietitians, technical personnel, super- visors, persons above the rank of supervisor, office staff, boiler house s t a f f , persons regularly employed f o r not more than twenty - four hours per week and persons employed for the school vacation periods and persons covered by existing collective L- agreements. The Hospital undertakes t h a t during t h e lifetime of t h i s Agreement it w i l l not enter into any other agreement or contract with employees represented by the Union either individ - ually or collectively which w i l l conflict with any of the pro- visions of t h i s Agreement.
ARTICLE SCOPE AND RECOGNITION. The Company recognizes the Union as the sole and exclusive bargaining agent for all employees of the Company in the Municipality of Ottawa, save and except Supervisors, Site Managers, persons above the rank of Supervisor, sales, office, and clerical staff. No work performed by the Bargaining Unit shall be contracted out during the term of the Agreement. The Union agrees that, except as provided for in this Agreement, there be no Union activity on the premises of the Company except by agreement with the Company.
ARTICLE SCOPE AND RECOGNITION. The Employer recognizes the Union as the sole Collective Bargaining Agent for all employees of Community Living Burlington save and except managers, persons above the rank of managers and administration staff. The Employer undertakes that it not enter into any other agreement or contract with those employees for whom the Union has bargaining rights, either individually or collectively, which would with any of the provisions of this Agreement. Nothing in this Agreement shall preclude the involvement of families and friends, the use of volunteers, students, or persons with a developmental disability on a vocational job placement or in other service areas in the performance of any work. Neither will be used to replace a bargaining unit employee or to reduce their regular hours of work. This Agreement shall not be applicable to any employee hired by the Employer under any special government grant for extra enrichment or training programs. People with a developmental disability who are receiving services from the Association are expressly excluded from this collective agreement. It is understood that individuals of services Participating in training programs will not result in a reduction in union positions. Persons employed for a definite term or non-repetitivetask provided that the or task is no longer than months are also excluded from this collective agreement.
