Archive. An archive recording may be made and retained by the engaging orchestra. Such recordings will be held by the engager and not shared externally, excepting with a) featured composers, for their own private study purposes; b) funders, for the purposes of reporting (e.g. where a funder requests to view an archive recording as evidence of a sponsored project); and c) educational project participants, as a private record of their participation. An engager may elect to make use of an archive recording made under this agreement for promotional purposes, provided that such usage is in accordance with ii) below. Any subsequent commercial exploitation of archive recordings shall be subject either to the terms of prevailing Collective Agreements, or to separate negotiation with the Union.

This recording will not be shared externally with the exception of (i) research purposes, (ii) featured composers for their own study, (iii) for purposes of reporting to funders (where required), (iv) for purposes of education (v) for purposes of securing work by sending via private communication to potential work partners (vi) a DVD copy or secure private link for participants, via an online streaming platform such as Youtube. In the case of (vi), Sinfonia Viva must make participants aware that both DVD copies and private links may only be used for archive purposes, and not used commercially. Recordings will, where possible, be watermarked throughout their duration to deter unauthorised uses. Such archive recordings may be commercially exploited subject to the terms and unit allocation in Clause (a) of this Media Agreement without additional payment to the Musician.

If any RMail Gateway service used is used for message archiving, it is the responsibility of the customer to manage their desired archive retention policies and remain current for fees associated with archive storage. RPost retains the right to purge archived messages after a customer ceases to make timely payments for services or otherwise cancels their service agreement for RPost services. If service fees are less than 90 days past due, RPost shall provide at least one electronically delivered notice with a record of sending attempt, to the last recorded administrator email address associated with the customer account prior to purging an archive. If service fees are more than 90 days past due, RPost does not have any obligation to continue to store data and may purge data without notice.
