Common use of Appropriate Safeguards Clause in Contracts

Appropriate Safeguards. Business Associate shall use appropriate physical, technical and administrative safeguards, and shall comply with the Security Rule with respect to ePHI, to prevent use or disclosure of PHI other than as provided for by this Agreement or as Required by Law.

Appropriate Safeguards. Business Associate shall use agrees to implement appropriate physicaland reasonable administrative, technical and administrative safeguards, and shall comply with the Security Rule with respect to ePHI, physical safeguards to prevent use or disclosure of the PHI other than as provided for by this Agreement or as Required by LawAgreement.

Appropriate Safeguards. Business Associate shall use establish, implement and maintain appropriate physical, technical and administrative safeguards, and shall comply with the Security Rule Standards (Subpart C of 45 C.F.R. Part 164) with respect to ePHIelectronic PHI, as necessary to prevent any use or disclosure of PHI other than as provided for by this Agreement or as Required by LawAddendum. Without limiting the generality of the foregoing, Business Associate agrees to protect the integrity and confidentiality of any PHI it electronically exchanges with Covered Entity.

Appropriate Safeguards. Business Associate shall agrees to use appropriate physicaladministrative, technical and administrative physical safeguards, and shall comply consistent with the Security Rule with respect to ePHIsize and complexity of Business Associate’s operations, to protect the confidentiality of PHI and to prevent the use or disclosure of PHI or Electronic PHI other than as provided for permitted or required by this Agreement or as Required by Law.Agreement.22

Appropriate Safeguards. Business Associate shall use reasonable and appropriate physicalsafeguards and comply, technical and administrative safeguardswhere applicable, and shall comply with the Security Rule with respect to ePHI, to prevent use or disclosure of PHI and/or ePHI other than as provided for by this Agreement or as Required by Law.Agreement. Business Associate shall implement administrative, physical and technical safeguards in accordance with the Security Rule under 45 C.F.R. §§ 164.308, 164.310, 164.312 and 164.316:

The Business Associate shall use will implement, to the Department’s satisfaction, all reasonable and appropriate physicaladministrative, physical and technical safeguards to protect the confidentiality, integrity and administrative safeguardsavailability of PHI. Safeguards will be implemented for paper as well as electronic versions of PHI. Business Associate will ensure that any agent or subcontractor to whom it provides PHI received from, created or received by Business Associate on behalf of the Department agrees to the same restrictions and shall comply with conditions which apply through this Agreement to the Security Rule Business Associate with respect to ePHI, to prevent use or disclosure of PHI other than as provided for by this Agreement or as Required by Lawsuch information.

(i) The Business Associate shall use appropriate physical, technical and administrative safeguards, safeguards and shall comply with the Security Rule with respect to ePHIElectronic PHI, to prevent the use or and disclosure of PHI other than as provided for by the Agreement and this Agreement or as Required by LawAmendment.

Business Associate shall maintain a comprehensive written information privacy and security program that includes administrative, technical and physical safeguards appropriate to the size and complexity of the Business Associate’s operations and the nature and scope of its activities.

Business Associate shall use appropriate physicalimplement administrative, physical and technical safeguards that (i) reasonably and administrative safeguardsappropriately protect the confidentiality, integrity and shall comply with availability of electronic PHI that it creates, receives, maintains or transmits on behalf of Covered Entity; and (ii) prevent the Security Rule with respect to ePHI, to prevent use Use or disclosure Disclosure of PHI other than as provided for contemplated by the Underlying Agreement and this Agreement or as Required by LawBA Agreement.

Appropriate Safeguards. Business Associate shall will use appropriate physical, technical safeguards and administrative safeguards, and shall will comply with the applicable provisions of the Security Rule with respect to ePHIElectronic PHI, to prevent use or disclosure of PHI such information other than as provided for by the Underlying Agreement and this Agreement. To the extent that Business Associate is required to carry out any of Healthcare Provider’SS obligations under the Privacy Rule as expressly provided in the Underlying Agreement or as Required by Lawthis Agreement, Business Associate will comply with the requirements of the Privacy Rule that apply to Healthcare Provider in the performance of such obligations.

Appropriate Safeguards. Business Associate shall use implement appropriate administrative, technical, physical, technical and administrative safeguards, and shall comply security safeguards in compliance with the Privacy Rules, Security Rule with respect to ePHIRules and the HITECH Act that reasonably and appropriately protect the confidentiality, to prevent use or disclosure integrity and availability of PHI other than as provided for that it creates, receives, maintains or transmits on behalf of Covered Entity. As required by this Agreement or as Required by Lawlaw, Business Associate shall maintain policies, procedures and documentation that address these safeguards and which are appropriate to the size and complexity of the Business Associate's operations and the nature and scope of its services.

Appropriate Safeguards. Business Associate shall will use appropriate physical, technical and administrative safeguards, and shall comply in accordance with the Security Rule with respect to ePHIpolicies and procedures of Business Associate, to prevent use or disclosure of PHI other than as provided for by this Agreement Agreement. In addition, Business Associate will implement administrative, physical, and technical safeguards that reasonably and appropriately de-identify, protect the confidentiality, integrity, and availability of the Electronic Protected Health Information that it creates, receives, maintains, or as Required by Lawtransmits on behalf of Covered Entity, consistent with Business Associate’s internal policies.

Appropriate Safeguards. Business Associate shall use implement appropriate physicaladministrative, technical and administrative safeguards, and shall comply physical safeguards in compliance with the Security Rule with respect to ePHI, Privacy Regulations as are necessary to prevent the use or disclosure of PHI PHI, other than as provided for permitted by this Agreement or as Required by LawBA Agreement.

Appropriate Safeguards. Business Associate shall use appropriate physical, technical and administrative safeguards, safeguards and shall comply with the Security Rule with respect to ePHIElectronic PHI, to prevent use or disclosure of PHI such information other than as provided for by the Terms of Service and this Agreement or as Required by LawBAA.

Appropriate Safeguards. Business Associate shall use implement appropriate physical, technical and administrative safeguards, and shall comply with the Security Rule with respect to ePHI, safeguards as are necessary to prevent the use or disclosure of PHI other than as provided for permitted by this Agreement or as Required by LawAgreement. The appropriate safeguards will comply with Subpart C of 45 CFR Part 164 with respect to electronic protected health information. Business Associate shall maintain a comprehensive written information privacy and security program that includes administrative, technical and physical safeguards appropriate to the size and complexity of the Business Associate’s operations and the nature and scope of its activities.
