Appraisal Review. The Consultant will furnish appraisal review services by a Wisconsin Certified General Appraiser, qualified by training and recent airport experience, and able to prepare and furnish the appraisal review reports required to determine current fair market value. The same review appraiser should review both the agency and property owner appraisals. The Consultant shall apply the legal opinions and conclusions of law as given by the Department; shall use proper and applicable appraisal techniques, methods and analyses; and, agrees to prepare the appraisal review reports in accordance with the Bureau’s policies, Appraisal and Appraisal Review Guidelines for Land Acquisition. The appraiser who completed the appraisal review must be the person to officially sign the appraisal review report.

Appraisal Review. (1) Appraisal reports shall be reviewed by a qualified review appraiser meeting the qualifications set forth in paragraph (a) of this section. Statements of value prepared by agency appraisers are not subject to this review. (2) The review appraiser shall determine whether the appraisal report: (i) Is complete, logical, consistent, and supported by market analysis; (ii) Complies with the standards prescribed in paragraph (c) of this section; and (iii) Reasonably estimates the probable market value of the lands appraised. (3) The review appraiser shall prepare a written review report, containing at a minimum: (i) A description of the review process used; (ii) An explanation of the adequacy, relevance, and reasonableness of the data and methods used by the appraiser to estimate value; (iii) The review appraiser's conclusions regarding the appraiser's estimate of market value; and (iv) A certification by the review appraiser to the following: (A) The review appraiser has no present or prospective interest in the property which is the subject of the review report; and (B) The review appraiser has not received compensation that was contingent upon approval of the appraisal report. § 254.10

Appraisal Review. If either party concludes that an Appraisal contains a material omission or material error of fact, such party may, within 10 days after receipt of the Appraisal, request a reconsideration of the Appraisal, as allowed by applicable law, at the party’s own cost.

The cost of the appraiser’s expert witness testimony for trial is not part of this contract, and shall be paid by the COUNTY. 5) APPRAISAL UPDATES YES NO a) Prepare complete appraisal update for the parcel to be acquired utilizing TxDOT Form No. ROW-A-5, which will be furnished to the provider by TxDOT. These reports shall conform to COUNTY/TxDOT policies and procedures along with the Uniform Standards of Professional Appraisal Practices. YES NO b) As necessary, prepare written notification to COUNTY/TxDOT of any environmental concerns associated with the right of way to be acquired which could require environmental remediation. All completed appraisals will be administratively reviewed by L&G Engineering Right of Way Office and recommended for approval by TxDOT. YES NO c) As necessary, the appraiser will appear or testify as an Expert Witness in eminent domain proceedings and be available for pre-hearing or pre-trial meetings as directed by the TxDOT/COUNTY. YES NO d) The cost of the appraiser appearing as an expert witness for testimony at special commissioners hearing must be included in the proposed fee schedule for the appraiser.
