APPOINTMENT OF XXXXXXX. The Employer has the exclusive right to appoint a xxxxxxx at the xxxxxxx’x hourly rate of wages and when required revert a xxxxxxx back to a journeyman’s rate. Should any dispute arise on the job over the appointment or demotion of a xxxxxxx, the employees must remain on the job and at work until such dispute is settled under the grievance and arbitration procedure.

APPOINTMENT OF XXXXXXX. The Union may appoint up to five (5) bargaining unit employees to serve as Union stewards and five (5) additional employees to serve as alternate Union stewards.

APPOINTMENT OF XXXXXXX. XXXXXX AS PROCESS AGENT. IN ADDITION TO THE CONSENT TO SERVICE SET FORTH IN SECTION 8.3 HEREOF, ANY GUARANTOR THAT IS NOT A SUBSIDIARY THAT IS ORGANIZED UNDER THE LAWS OF ANY STATE OF THE UNITED STATES OR THE DISTRICT OF COLUMBIA THAT BECOMES A GUARANTOR HEREUNDER HEREBY IRREVOCABLY AND UNCONDITIONALLY APPOINTS THE COMPANY AS ITS AGENT TO RECEIVE, ON BEHALF OF ITSELF AND ON BEHALF OF ITS PROPERTY, SERVICE OF COPIES OF THE SUMMONS AND COMPLAINT AND ANY OTHER PROCESS WHICH MAY BE SERVED IN ANY SUCH ACTION OR PROCEEDING, AND THE COMPANY HEREBY IRREVOCABLY AND UNCONDITIONALLY ACCEPTS SUCH APPOINTMENT. SUCH SERVICE MAY BE MADE BY MAILING OR DELIVERING A COPY OF SUCH PROCESS TO SUCH GUARANTOR IN CARE OF THE COMPANY AT ITS ADDRESS FOR NOTICES AS SET FORTH IN SECTION 10.02 OF THE CREDIT AGREEMENT, AND SUCH GUARANTOR HEREBY IRREVOCABLY AUTHORIZES AND DIRECTS THE COMPANY TO ACCEPT SUCH SERVICE ON ITS BEHALF.
APPOINTMENT OF XXXXXXX. AMCO hereby appoints Xxxxxxx to act as an investment adviser for each Fund Account in accordance with the terms and conditions of this Agreement. Xxxxxxx will be an independent contractor and will have no authority to act for or represent the Trust or AMCO in any way or otherwise be deemed an agent of the Trust or AMCO except as expressly authorized in this Agreement or another writing by the Trust, AMCO and Xxxxxxx. Xxxxxxx accepts such appointment and agrees to render the services herein set forth for the compensation herein provided.
APPOINTMENT OF XXXXXXX. IMCO hereby appoints Xxxxxxx to act as an investment adviser for each Fund Account in accordance with the terms and conditions of this Agreement. Xxxxxxx will be an independent contractor and will have no authority to act for or represent the Trust or IMCO in any way or otherwise be deemed an agent of the Trust or IMCO except as expressly authorized in this Agreement or another writing by the Trust, IMCO and Xxxxxxx. Xxxxxxx accepts such appointment and agrees to render the services herein set forth for the compensation herein provided.
APPOINTMENT OF XXXXXXX. Section 2.12. The Employer recognizes the right of the Union to appoint a xxxxxxx at any shop or job where workmen are employed under the terms of this Agreement. Such xxxxxxx shall be allowed sufficient time during working hours to see that the provisions of this Agreement are observed at his shop or job. Under no circumstances shall a xxxxxxx be discriminated against by any Employer because of faithful performance of his duties as xxxxxxx. The Xxxxxxx in the event of any grievance or dispute shall notify the Employer or his representative in a sincere effort to settle this dispute or grievance before the Business Agent is notified. The Xxxxxxx shall be permitted to remain on the job when two or more men are required to work overtime and shall assume his share of the work; if possible he is to be notified at least one hour before quitting time. The Xxxxxxx shall remain on the job until its completion. The Xxxxxxx shall see that all overtime shall be equally divided among all employees employed on the job so far as practical. He shall furnish the Business Manager a weekly report of names and number of overtime hours worked by each employee. In the event any employee employed under the terms of this Agreement requires first aid while on the job, the Xxxxxxx shall see that the first aid required is furnished by the Employer and file necessary accident reports with the Employer and the Union.
