Common use of Appointment of Successor Trustee Clause in Contracts

Appointment of Successor Trustee. Beneficiary may, from time to time, by a written instrument executed and acknowledged by Beneficiary, mailed to Trustor and recorded in the county in which the Trust Estate is located and by otherwise complying with the provisions of applicable law, substitute a successor or successors to any Trustee named herein or acting hereunder, and such successor(s) shall, without conveyance from the Trustee predecessor, succeed to all title, estate, rights, powers and duties of such predecessor.

Appointment of Successor Trustee. Beneficiary maymay substitute a trustee or trustees to execute the trust hereby created, from time to time, by a written instrument executed and acknowledged by Beneficiary, mailed to Trustor and recorded when such substitution has been filed for record in the county office of the Recorder of the County in which the Trust Estate is located and by otherwise complying with located, it shall be conclusive evidence of the provisions appointment of applicable law, substitute a successor such trustee or successors to any Trustee named herein or acting hereundertrustees, and such successor(s) shall, without conveyance from the Trustee predecessor, new trustee or trustees shall succeed to all title, estate, rights, of the powers and duties of such predecessorthe trustee or trustees named herein.

To the extent permitted by law, Beneficiary may, from time to time, by a written instrument executed and acknowledged by Beneficiary, mailed to Trustor and recorded in the county counties in which the Trust Estate is located and by otherwise complying with the provisions of applicable law, substitute a successor or successors to any Trustee named herein or acting hereunder, and such successor(s) shall, without conveyance from the Trustee predecessor, succeed to all title, estate, rights, powers and duties of such predecessor.
