Common use of Application of Terms and Conditions Clause in Contracts

The contract will be on these terms and conditions to the exclusion of all terms, conditions and warranties including any terms and conditions which the customer purports to apply under any purchase order, confirmation of order, or similar document, whether or not such document is referred to in the contract or which are implied by trade, custom, practice or course of dealing. The signing by Generix of the customer’s documentation shall not imply any modification of these terms and conditions.
