Common use of Application of Prepayments Clause in Contracts

Application of Prepayments. In the case of each partial prepayment of the Notes pursuant to the provisions of Section 4(b) or 4(c), the principal amount of the Notes of the Series to be prepaid shall be allocated among all of the Notes of such Series at the time outstanding in proportion, as nearly as practicable, to the respective unpaid principal amounts thereof.

Application of Prepayments. In the case of each partial prepayment of the Notes pursuant to the provisions paragraph 4A or 4B of Section 4(b) or 4(c)all outstanding Notes of any Series, the principal amount of the Notes of the Series to be prepaid shall be allocated among to all of the Notes of such Series at the time outstanding (including, for the purpose of this paragraph 4D only, all Notes prepaid or otherwise retired or purchased or otherwise acquired by the Company or any of its Subsidiaries or Affiliates other than by prepayment pursuant to paragraph 4A or 4B) in proportion, as nearly as practicable, proportion to the respective unpaid outstanding principal amounts thereof.

Application of Prepayments. In the case of each partial prepayment of the Notes pursuant to the provisions of Section 4(b) ss.2.2 or 4(c)2.3, the principal amount of the Notes of the Series to be prepaid shall be allocated among all of the Notes of such Series at the time outstanding in proportion, as nearly as practicable, to the respective unpaid principal amounts thereof.

Application of Prepayments. In the case of each partial prepayment of the Notes pursuant to the provisions of Section 4(b5(b) or 4(c5(c), the principal amount of the Notes of the Series to be prepaid shall be allocated among all of the Notes of such Series at the time outstanding in proportion, as nearly as practicable, to the respective unpaid principal amounts thereof.
