Common use of Application of Insurance Proceeds Clause in Contracts

Application of Insurance Proceeds. The proceeds from all insurance claims, except life and injury, shall be paid to the Concessionaire and it shall notwithstanding anything to the contrary contained in this Agreement, apply such proceeds towards payment of Damages and balance remaining, if any, shall be applied for any necessary repair, reconstruction, reinstatement, replacement, improvement in the Resort and Project Infrastructure, in accordance with the provisions contained in this behalf in the Financing Agreements.
