Appearance as Witness. If and when required by the City, the Contractor, or an appropriate representative, shall prepare and appear for any litigation concerning any relevant project or related contract, on behalf of the City. The Contractor shall be equitably paid, to the extent permitted by law, for such services and for any reasonable expenses incurred in relation thereto, in accordance with the Agreement.
Appearance as Witness. Notwithstanding any other provision of this Article 8, the Company may pay or reimburse expenses incurred by a Manager in connection with his or her appearance as a witness or other participation in a Proceeding at a time when he or she is not a named defendant or respondent in the Proceeding.

If requested by the FBGPTRA, or on its behalf, the Engineer shall prepare such engineering exhibits and plans as may be requested for all hearings and trials related to the Project and, further, it shall prepare for and appear at conferences at the office of the FBGPTRA and shall furnish competent expert engineering witnesses to provide such oral testimony and to introduce such demonstrative evidence as may be needed throughout all trials and hearings with reference to any litigation relating to the Project. Trial preparation and appearance by the Engineer in courts regarding litigation matters are Additional Services and compensation will be paid in accordance with Section 2(b).

If requested by the FBCTRA, or on its behalf, the Engineer shall, as an Additional Service, prepare such engineering exhibits and plans as may be requested for all hearings and trials related to the TRA System and the GPTRA System, respectively, and, further, it shall prepare for and appear at conferences at the office of the FBCTRA and shall furnish competent expert engineering witnesses to provide such oral testimony and to introduce such demonstrative evidence as may be needed throughout all trials and hearings with reference to any litigation relating to the TRA System and the GPTRA System, respectively. Trial preparation and appearance by the Engineer in courts regarding litigation matters are Additional Services and compensation will be paid in accordance with Section 2(b).

Trial preparation and appearance by the Consultant in courts regarding litigation matters are Additional Services and compensation will be paid in accordance with Section 2(b).

If and when required by the Municipality, a Municipal Project Manager, or an appropriate representative, shall prepare and appear for any litigation concerning any relevant project or related Agreement, on behalf of the Municipality. The Municipal Project Manager shall be equitably paid for such services and for any reasonable expenses incurred in relation thereto, in accordance with the Contract document.
Appearance as Witness. If and when ·required by MassDOT, the Consultant shall prepare for and appear in any litigation concerning this project in behalf of the Commonwealth, and shall be paid on a costs plus a net fee basis for his/her services and shall be reimbursed for any expenses incurred in relation thereto. These services and expenses shall not be considered as covered by the total of the fees stipulated in this Contract.
Appearance as Witness. If and when required by the Department, the Consultant shall prepare for and appear in any litigation concerning this project on behalf of the Commonwealth, and shall be paid actual salary and overhead costs with no profit allowance for this services and shall be reimbursed for any expenses incurred in relation thereto. These services and expenses shall not be considered as covered by the total of the fees stipulated in this contract.

If requested by FBCTRA, or on its behalf, ARA shall, as an Additional Service, prepare such engineering exhibits and plans as may be requested for all hearings and trials related to the TRA System and the GPTRA System, respectively, and, further, it shall prepare for and appear at conferences at the office of the FBCTRA and shall furnish competent expert engineering witnesses to provide such oral testimony and to introduce such demonstrative evidence as may be needed throughout all trials and hearings with reference to any litigation relating to the TRA System and the GPTRA System, respectively. Trial preparation and appearance by ARA in courts regarding litigation matters are Additional Services and compensation will be paid in accordance with Section 2(b).
