Annual leave definitions. For the purposes of this clause: "Ordinary pay" in relation to any Employee means the standard weekly payment received by the Employee including "regular" allowances.
Annual leave definitions. Annual Leave Loading has been absorbed into the total hourly rate and averaged annual wage as described in clause 18 of this agreement. Employees working as roster (clause 22) are deemed as shift workers and entitled to one additional week of annual leave 5 weeks in total, pursuant to the National Employment Standards. Excessive accumulated leave Kalari may direct employees to take any annual leave credited to the employees, in circumstances where o there is a close down of that part of Xxxxxx’s business in which the employees work. If an employee does not have enough accrued annual leave to cover all or part of the close down period, the relevant employees agree that he/she will take leave without pay. Such leave without pay will still count as service and he/she will continue to accrue relevant leave entitlements during those periods. o the employee has accrued annual leave of more than 8 weeks; and o the amount of annual leave the employee is directed to take is less than, or equal to, 1/4 of the amount of accrued annual leave the employee has at the time the direction is given. Cashing out annual leave An employee may elect to receive payment in lieu of taking annual leave under this Agreement provided that: ▪ the employee has accrued at least that amount of annual leave; ▪ the employee has given Xxxxxx a written request to cash out some or all of their accrued annual leave entitlement; and ▪ Xxxxxx authorises the employee’s request. ▪ a minimum accrued amount of 4 weeks annual leave is retained In electing to cash out a portion of accrued annual leave, the employee will no longer be entitled to take that amount of leave. Rules about taking annual leave An employee who accrues an entitlement to annual leave may request to take all or any part of that leave by providing Xxxxxx with a written request. Approval of the request for annual leave by Xxxxxx is subject to: ▪ the operational requirements of the workplace; and ▪ the employee having accrued at least that amount of annual leave requested. Xxxxxx will not unreasonably refuse an employee’s request to take accrued annual leave. Annual leave at half pay By agreement with Xxxxxx, an employee may request to take annual leave at half pay. This will enable the employee to access additional leave to assist in balancing work and family obligations. In considering this request, regard must be had to the operational requirements of the workplace.
