AIRCRAFT AND CREW. LEA shall operate the Aircraft for the Charterer's sole use, manned and equipped for the performance of the Charter. Any additional services shall be specified in the Agreement.
AIRCRAFT AND CREW. 7.1 The captain of the Aircraft shall have complete discretion concerning preparation of the load carried and its distribution and of the Aircraft f or flight, whether or not a Flight shall beundertaken or abandoned once undertaken and deviation from proposed route, where landing shall be made and all such other matters relating to the operation of the Aircraft and the Charterer shall accept all such decisions as final and binding. 7.2 All ground and operating personnel, including cabin staff, are authorized to take orders only from the Carrier unless specific written agreement shall first have been obtained from the Carrier whereby certain defined instructions may be accepted by such personnel from the Charterer. 7.3 Subject always to the Carrier’s conditions of carriage, in the event that a passenger’s conduct, behaviour or health is deemed by the captain of the Aircraft to cause, or be likely to cause, discomfort or nuisance to other passengers or jeopardise the safety of the passengers and/or the Aircraft, then the captain of the Aircraft shall be entitled to take any action deemed necessary to procure the safety of the passengers and Aircraft including, but not limited to diverting or returning to the airport of departure and/or removing the passenger(s) in question. If such action is deemed necessary, Charterer shall compensate SaxonAir against any loss incurred by SaxonAir as a result of such diversion and removal.
AIRCRAFT AND CREW. 3.1 The Supplier shall procure the Carrier to provide the Aircraft at the commencement of the Flight properly manned and equipped, fueled, and airworthy in accordance with the laws and regulations of the state of registration of the Aircraft and the Aircraft shall be operated in accordance with all applicable laws and regulations during the period of the Flight(s). In the event that any Flight is delayed through no fault of the Supplier or the Carrier, the Charterer shall pay to the Supplier Demurrage/Standing Charge at the rate set out in the Schedule. 3.2 The times shown in the Schedule are approximate and not guaranteed and the Carrier is entitled to deviate from the Flight schedule and/or the duration of the Flight and/or to reduce the maximum payload. The captain of the Aircraft shall have complete discretion concerning preparation of the Aircraft for flight, whether or not a Flight shall be undertaken or abandoned once undertaken, any deviation from proposed route, where landing shall be made and all such other matters relating to the operation of the Aircraft and the Charterer shall accept all such decisions as final and binding. 3.3 All ground and operating personnel including cabin staff are authorised to take orders only from the Carrier unless specific written agreement shall first have been obtained from the Carrier whereby certain defined instructions may be accepted by such personnel from the Charterer. 3.4 The Supplier may at its discretion and without prior notice substitute the Aircraft and/or the Carrier, for the same or similar class of aircraft and carrier where possible; and such substitute aircraft and substitute carrier shall, for the purposes of this Agreement, be the Aircraft and the Carrier hereunder. To the extent that such substitution involves additional costs, such additional costs shall be charged to Charterer.

AIRCRAFT AND CREW. 6.1 The Carrier shall make available a properly equipped and fuelled Aircraft with crew according to the regulations at the agreed start of the Flight for the performance of the Flight Schedule. 6.2 If the Aircraft shall for any reason (whether before or after the commencement of the Flight Schedule) become incapable of undertaking or continuing all or part of the Flight Schedule the Carrier may at its discretion substitute therefore one or more aircraft of the same or another type and the provisions of the Agreement shall apply mutates mutandis to the substituted aircraft. If the Carrier does not substitute another aircraft it shall not be under any liability to the Charterer and the Charterer shall remain liable to pay for that part of the Flight Schedule (if any) that has been performed at the time the Aircraft becomes so incapable.
AIRCRAFT AND CREW. 3.1 FlyEliteJets is a broker providing aviation services including aircraft management, aircraft charters and aircraft sales. When brokering aircraft services, FlyEliteJets acts solely as a third-party aircraft broker. FlyEliteJets responsibilities under these Conditions shall be limited to sourcing Aircraft for the Charterers charter requests. 3.2 FlyEliteJets shall provide for the Charterer's sole use the Aircraft, manned and equipped for the performance of the Charter Flight. Any additional services shall be specified in the Charter Agreement. 3.3 In the event that the Aircraft is unavailable following signature of the Charter Agreement, or unable to perform any part of the Chartered Flight for any reason, FlyEliteJets shall be entitled to substitute without prior notice or compensation the Aircraft offered with an equivalent aircraft which will be suitable for carrying out The Charter Flight. These Conditions shall apply mutatis mutandis to any substitute aircraft. 3.4 Each Chartered Flight shall be operated on a chartered basis, and is subject to timely receipt of necessary traffic and over flight permission and traffic rights being obtained. 3.5 The Aircraft shall only be used in compliance with the laws and regulations of the relevant authorities of any country from, to, or over which the Aircraft is flown. 2.6 The Charterer shall comply with and shall procure that all passengers and owners of goods or other persons having an interest in goods carried in the Aircraft, to observe and comply with all traffic regulations of the Carrier and all customs, police, public health and other laws and regulations which are applicable in countries which flights are originated, landing made, or over which flights are made. 3.7 The Captain shall have absolute discretion: 3.7.1 to refuse any passenger(s), baggage, cargo or part thereof; 3.7.2 to decide what load may be carried on the Aircraft and how it shall be distributed; and 3.7.3 to decide whether and when a flight may be safely undertaken; and 3.7.4 where and when the Aircraft should land. 3.8 Charterer shall comply, and shall ensure that all passengers comply with the Captains requests at all times. 3.9 The Charterer acknowledges that crew time duty is restricted by applicable crew duty time limitations regulations. AIRCRAFT AND CREW. Carrier shall provide the Aircraft for Customer’s use, properly equipped, manned and fuelled. The crew, who shall be Carrier’s employees, servants or agents, shall, except as otherwise provided herein, fly the Aircraft on the Flight Scheduled during the period specified in the Charter Agreement which is made subject to these Further Terms and Conditions ("the Charter Agreement").

For the purpose of the agreed Charter Flight, the Carrier is required to provide suitably equipped and fueled aircraft and crew in accordance with the applicable regulations. 3.2. In case the competent authorities request a change in configuration of the aircraft after the Agreement has been signed and the seats available to the Client shall be fewer than originally agreed, the Client may request pro-rata reduction of the airfare. Provided that the Carrier refuses to grant such price reduction the Client has the right to unilaterally terminate the Agreement by paying to the Carrier the costs incurred by it so far. The Carrier is obliged to immediately inform the Client about the reduction of the number of available passenger seats. The Client shall immediately notify the Carrier of its request for a reduction in the Airfare or for the termination of the Agreement or otherwise it loses this right. 3.3. The Carrier has the right at any time to replace the aircraft with one or several other aircraft suitable for the agreed Flight after notifying the Client in advance. 3.4. Provided that such replacement shall lead to additional costs the Client shall be notified thereof and may accept or refuse timely manner such an updated offer. 3.5. Passengers that are intoxicated, under the influence of narcotic substances, contagiously ill, as well as mentally ill, posing a danger to other Passengers or to the safety of the flight, as well as those who have refused a security check, including of their luggage are not permitted for transportation. In these cases, the Client owes to the Carrier the full amount of the transport price. 3.6. The instructions of the Carrier and/or the Pilot in Command of the aircraft regarding the operation of the flight and observance of the established order onboard the aircraft are obligatory for all persons being on board. The Carrier and/or the Pilot in Command have the right at any time, without the Client being entitled to object, to: 3.6.1. decide regarding the safe performance of the Flight and the safe landing of the aircraft. 3.6.2. modify or cancel the scheduled Flight due to technical or safety reasons. 3.6.3. order to make or not make a landing and, if need be, divert from the route and/or to proceed to one or more emergency landings. 3.6.4. not permit on board the aircraft any Passenger or piece of baggage that endangers the flight safety. 3.6.5. make a decision about the dimensions and weight of the baggage that could be c...
