AGREEMENTS WITH THE UNITED STATES. This Permit is subject and subordinate to the Provisions of any agreements heretofore made between City and the United States government or government authority, relative to the operation or maintenance of the Airport, the execution of which has been or will be required as a condition precedent to the granting of federal funds or the approval to impose or use Passenger Facility Funds (“PFCs”) for the improvement or development of the Airport. Permittee shall not cause the City to violate any assurances made by the City to the United States government in connection with the granting of such federal funds or the approval of such PFCs. All Provisions of this Permit are subordinate to the rights of the United States of America to operate all of the Airport or any part thereof during time of war or national emergency. Such rights supersede any Provisions of this Permit inconsistent with the operation of the Airport by the United States of America.

This Agreement is subject and subordinate to the provisions of any agreement heretofore or hereafter made between the City and the United States, the execution of which is required to enable or permit the transfer of rights or property to the City for airport purposes, or the expenditure of federal grant funds for Airport improvement, maintenance or development. Airline shall reasonably abide by the requirements of agreements entered into between the City and the United States, and shall consent to amendments and modifications of this Agreement if required by such agreements or if required as a condition of the City’s entry into such agreements.
AGREEMENTS WITH THE UNITED STATES. X. XXXXXX acknowledges and agrees that XXXXXX has entered into certain Grant Agreements with the Federal Aviation Administration, conditions of which require that all parties leasing property from LESSOR agree to be bound by certain sponsor’s assurances given by XXXXXX to the United States Government under the Airport and Airway Improvement Act of 1982, as the same may be amended from time to time. Accordingly, XXXXXX on behalf of itself, its heirs, personal representatives, successors, and assigns, as additional consideration or the Lease of the PREMISES from LESSOR, does hereby covenant and agree for the term of this Lease to be bound by the provisions set forth on Exhibit “C” (Sponsors Assurances) attached hereto and incorporated herein by reference.

Tenant shall reasonably abide by requirements of agreements entered into between the Commission and the United States, and shall consent to amendments and modifications of this Lease if required by such agreement or if required as a condition of the Commission’s entry into such agreements.

This Agreement is subject and subordinate to the terms, reservations, restrictions and conditions of any existing or future agreements between the City and the United States, the execution of which has been or may be required as a condition precedent to the transfer of federal rights or property to the City for Airport purposes and the expenditure of federal funds for the extension, expansion or development of the Airport or airport system. The provisions of the attached Appendices 1, 2, 3 and 10 are incorporated herein by reference.
AGREEMENTS WITH THE UNITED STATES. This agreement and lease shall be subordinate to the provisions of any existing or future agreement between the Authority and the United States, relative to the operations or maintenance or the premises and other facilities, the execution of which has been or may be required as a prior condition to the expenditure of federal funds for the development of the premises and other facilities.

This Agreement is subject and subordinate to the provisions of any agreements heretofore made between County and the United States, relative to the operation or maintenance of the Airport, the execution of which has been required as a condition precedent to the transfer of Federal rights or property to County for Airport purposes, or to the expenditure of Federal funds for the extension, expansion, or development of the Airport, including the expenditure of Federal funds for the development of the Airport in accordance with the provisions of the Airport and Airway Development Act as it has been amended from time to time.

This Agreement is subject and subordinate to the provisions of any agreements heretofore or hereafter made between the Commission and the United States, the execution of which is required to enable or permit transfer of rights or property to the Commission for airport purposes or expenditure of federal grant funds for Airport improvement, maintenance or development, including without limitation all “Sponsor’s Grant Assurances” or like agreement that has been or may be furnished by the Commission to the United States. Tenant shall reasonably abide by requirements of agreements entered into between the Commission and the United States, and shall consent to amendments and modifications of this Agreement if required by such agreement or if required as a condition of the Commission’s entry into such agreements.

This Lease is subject and subordinate to the terms, reservations, restrictions, provisions and conditions of any existing or future agreement between Landlord and the Unites States relative to the operation or maintenance of the Xxxxxxxxx County Airport and its appurtenant facilities, the execution of which has been or may be required as a condition precedent to the participation by any Federal agency in the extension, expansion or development of said airport and facilities.
