AGREEMENT TIME. The Work to be performed pursuant to this Agreement shall be completed pursuant to the time as set forth in the PO (“Contact Time”). Time is of the essence.

AGREEMENT TIME. Agreement Duration is Calendar Days. The Pre-Construction Services described in this Agreement must be performed by CM@Risk in accordance with the Pre- Construction Schedule set forth in attached Exhibit A, as updated and expanded in the most current updated/revised and approved Detailed Project Schedule. Failure on the part of CM@Risk to adhere to the Pre-Construction Schedule requirements for activities for which it is responsible and in control will be deemed a material breach and sufficient ground for termination for cause of this Agreement by City.
AGREEMENT TIME. Time is of the essence of this Agreement and, except where stated otherwise, references in this Agreement to days shall be construed to refer to calendar days. Contractor agrees that Contractor shall commence the Services immediately following City's acceptance of this Agreement ("Commencement Date"). Contractor agrees that Contractor shall perform the Services diligently and continuously throughout the term of the Agreement. The initial term of this Agreement shall be for one year, beginning on the Commencement Date ("Initial Term"). This Agreement shall automatically be renewed for up to three additional one-year terms (each a "Renewal Term"), unless either party, at least ninety days prior to the end of the then- applicable Agreement term, notifies the other party in writing of its intent not to renew this Agreement for the next Renewal Term.
AGREEMENT TIME. 6.1.1 The Agreement Time will start with the Notice to Proceed (“NTP”) and end with Final Acceptance.
AGREEMENT TIME. Time is of the essence in the performance of the Work under this Agreement. The “Pre- Construction Commencement Date” shall commence with the execution of this Agreement. Construction Manager shall commence the Pre-Construction Phase Services portion of the Work within five (5) calendar days after the Pre-Construction Phase Commencement Date. Any Work performed by Construction Manager prior to the Pre-Construction Phase Commencement Date shall be at the sole risk of Construction Manager and not compensable from the City. Because the Work is to be completed in two phases, the timely completion of the first Phase is critical to the timely completion of the second phase and, therefore, completion of the entire Project. Accordingly, Construction Manager agrees to provide the Pre- Construction Phase Services in accordance with the design schedule established pursuant to the terms of the City’s agreement with the Consultant, which requires that the Construction Manager complete all Pre-Construction Work and submit the GMP Proposal no later than fifteen (15) working days after the Consultant has completed 95% Construction Documents, which shall be determined by the Consultant’s agreement with the City.
