Agreement Goals. A. In accordance with Section 316-a of Article 15-A and 5 NYCRR §142.13, the Consultant acknowledges that if Consultant is found to have willfully and intentionally failed to comply with the MWBE participation goals set forth in the Agreement, such a finding constitutes a breach of contract and the Consultant shall be liable to the Fund for liquidated or other appropriate damages, as set forth herein. D. The Consultant understands that only sums paid to MWBEs for the performance of a commercially useful function, as that term is defined in 5 NYCRR §140.1, may be applied towards the achievement of the applicable MWBE participation goal. The portion of a contract with an MWBE serving as a supplier, that shall be deemed to represent the commercially useful function performed by the MWBE, shall be 60 percent of the total value of the contract. The portion of a contract with an MWBE serving as a broker, that shall be deemed to represent the commercially useful function performed by the MWBE, shall be the monetary value for fees, or the markup percentage, charged by the MWBE. Agreement Goals. The goals of this Agreement are to: • Advance the development of Recipient’s on-site manufacturing technology and 3DCP tall (> 120m height) tower that lowers wind energy costs, reduces environmental lifecycle impacts, and improves the competitiveness and economic benefits of wind energy in California. • Assess and reduce the environmental lifecycle impacts of 3DCP manufacturing • Evaluate and expand California’s R&D and commercial 3DCP capabilities and workforce potential needed to manufacture 3DCP wind energy components in California Ratepayer Benefits:2 This Agreement will result in the ratepayer benefits of greater electricity reliability, lower costs, and increased safety by manufacturing and conducting a pilot demonstration of low-cost RCAM tall (>120m in height) towers and offshore wind products on-site in California. The project will help provide important environmental and economic benefits for California electric ratepayers including (1) clean energy from land-based and offshore wind deployments, (2) wind energy manufacturing and operations jobs, (3) enhanced 3DCP educational and R&D capabilities, and (4) advancing a low-cost offshore wind components. Technological Advancement and Breakthroughs:3 This Agreement will lead to technological advancement and breakthroughs to overcome barriers to the achievement of the State of California’s statutory energy goals by advancing the technology readiness of Recipient’s 3DCP tower technology. The agreement also assesses the feasibility and viability of using 3DCP to manufacture two components for offshore floating wind turbines: a 3DCP suction anchor (3DSA) and a 3DCP hybrid anchor / energy storage system (three-dimensional (3D) StEnSea).

Where it appears that the Manager is unable to comply with the MWBE participation requirements, the Manager may submit in writing for the Fund’s consideration, the reasons for the Manager’s inability to meet any or all of the participation requirements together with an explanation of the efforts taken by the Manager to obtain the required MWBE participation pursuant to the provisions of New York State Executive Law Section 313 and the MWBE Regulations.
Agreement Goals. ‌ The overarching goal of the Plan, as outlined in the Agreement, is to reform WV’s children’s mental health services and system to help ensure children can receive mental health services in their homes and communities. Each year, the Plan helps lead WV to successful reform in a timely manner to reduce the number of children unnecessarily placed in RMHTFs, and to reduce the length of stay for children at these facilities, when appropriate. Specifically, the goal is threefold: 1. Prevent children with serious mental health conditions from being needlessly removed from their family homes to obtain treatment. 2. Prevent children with serious mental health conditions from unnecessarily entering RMHTFs. 3. Transition children with serious mental health conditions who have been placed in an RMHTF back to their family homes. To support these goals, DoHS is committed to providing HCBS to children in the target population. These programs will be family-driven, youth-guided, culturally and linguistically competent, and trauma-informed. They will include a broad and diverse array of HCBS that are individualized along with strength- and evidence-based. Through CQI efforts, DoHS will work to ensure statewide access to timely services to prevent crises and promote stability in the home. Key priorities in the coming year, as identified through quality improvement reviews, are captured in the Open Tasks subsection of each section of the Plan. The target population of these services, as defined in the Agreement, includes all children under the age of 21 who: 1. Have a serious emotional or behavioral disorder or disturbance that results in a functional impairment, and (i) who are placed in an RMHTF, or (ii) who reasonably may be expected to be placed in an RMHTF in the near future; and 2. Meet the eligibility requirements for mental health services provided or paid for by DoHS. DoHS successfully met the expected goal by December 31, 2022, which was a 25% reduction from the number of children living in RMHTFs as of June 1, 2015.3 The expected goal by December 31, 2024, is a 35% reduction in the number of children living in RMHTFs as of June 1, 2015. Additionally, any children residing in an RMHTF on December 31, 2024, will have been assessed by a qualified professional and determined to be in the most integrated setting appropriate to their individual needs.
Agreement Goals. 10 The goals of this Agreement are to: 11 • Enhance Cal-Adapt’s interactive web application to provide access—through easy-to- 12 use data download tools and interactive visualizations—to the climate projections that 13 are used for California’s Fifth Climate Change Assessment and that serve as a basis for 14 vulnerability assessments and planning by IOUs.

Agreement Goals. The goal of this Agreement is to lower the energy use during membrane (microfiltration followed by reverse osmosis in site 1, and microfiltration in site 2) treatment for water reclamation by 20% by the following activities: • Demonstrate that colloidal particles in various size ranges in the feed water can be reliably detected and quantified using the proposed technology. • Demonstrate that the technology can be successfully integrated to effectively function as an on-line/web-based monitoring device. • Demonstrate that the technology can help administer an appropriate amount of pre- treatment dose (e.g. coagulant dose to remove colloidal particles), based on the measured colloidal particles concentration. • Demonstrate that transmembrane pressure TMP across the MF membrane during pretreatment of feed water is significantly lower than that using untreated feed water. • Demonstrate that the MF permeate using pre-treated feed water does not unduly foul the downstream reverse osmosis (RO) membranes. • Conduct independent monitoring and verification to determine: (i) energy and cost savings of the technology compared to current processes, (ii) chemical usage, (iii) degree of fouling compared to current processes, and (iv) long term reliability and costs. • Demonstrate that the technology is cost effective for water reclamation facilities. • Plan to make the knowledge gained, results, and lessons learned available to the public to further commercialization of technology.
Agreement Goals. There are two main goals of this Agreement, over the next five years:  Divert individuals with serious mental illness away from inappropriate nursing facility placements by requiring comprehensive evaluations and providing services designed to enable them to live in community-based settings; and  Identify people with serious mental illness who have been admitted to nursing facilities but are able to and would like to transition to the community, and provide them with transition planning and community-based services sufficient to meet their needs. For the initial 18-month period of the Agreement, this implementation plan seeks to show how LDH will accomplish the following goals set forth by the DOJ: Agreement, and LDH’s commitment to ending unnecessary institutionalization of people in the Target Population (TP), consistent with ▇▇▇▇▇▇▇▇ principles;  Identify nursing facility residents in the Target Population who have the fewest barriers to transition and begin to transition those residents to the community using transition planning and community-based services in accordance with the provisions of this Agreement;  Conduct a gap analysis that identifies gaps in services and proposes goals and timeframes to remedy gaps in services;  Assess Medicaid services, rates, managed care contracts, and billing structures to identify barriers to the provision of community-based services for the Target Population;  Identify and implement incentives through Medicaid waiver, managed care, and provider contracts to increase use of community-based services and reduce reliance on institutional long- term care (LTC) for the Target Population;  Establish annual targets for diversion and transition of Target Population members to successful placements in the community.  Establish annual targets and strategies for decreasing referrals for individuals with SMI to nursing facilities;  Assign agency and division responsibility for achieving goals identified in the Initial Implementation Plan;  Continue collaborative efforts among State and local government agencies and entities to identify and address issues during the initial and subsequent implementation of this plan.
