Agreement Formation. 17.1. Any failure or delay by either party in exercising its rights under this Agreement shall not be construed as a waiver of such rights and the obligations of the other party shall continue.

Agreement Formation. The Purchase Order given to the Supplier by Geraldton Building Services & Cabinets Pty Ltd (GBSC) (“Purchase Order”) and these Standard Order Terms constitute an offer. A binding contract between GBSC and the Supplier will come into existence on the earlier of the date in which the Supplier confirms acceptance of the offer, or the Supplier commences delivery of any of the Goods or the performance of any Services (“Agreement”). In the event of an inconsistency between the terms of these Standard Order Terms and the Purchase Order, the terms of the Purchase Order shall prevail.
Agreement Formation. The Purchase Order (“PO”), these Terms and Conditions Agreement, and any referenced documents constitute the agreement of the parties (hereinafter “Agreement”). This Agreement may be accepted only by either written communication or by delivering the goods or performing the services ordered. THIS AGREEMENT IS LIMITED TO THE TERMS AND CONDITIONS SPECIFIED WITHIN THIS DOCUMENT. XXXXX DOES NOT AGREE TO ANY PROPOSED ADDITION, ALTERATION, OR DELETION BY SELLER. THE ISSUANCE OF ANY STATEMENT OR WRITING OF SELLER SHALL NOT ALTER, ADD TO, OR OTHERWISE AFFECT THESE TERMS AND CONDITIONS.
Agreement Formation. The agreement is formed when the Customer submits an application to us. However, in cases where the cost of a banquet, meeting, accommodation, or group use will exceed set price levels, and in the case of a wedding or celebration, the agreement is formed when the Customer pays Nidom an application fee of 50,000 yen or a booking fee Nidom separately specifies, by a date Nidom separately specifies. (The agreement is not formed if the application fee or booking fee is not paid by the date Nidom specifies.)
Agreement Formation. An offer is given based on the information the customer has given in the tender or otherwise, unless differently indicated in the offer. The offer is not binding to Ariterm if there is a change in the information the customer has given or there has been an error in the given information, or there is a change in the circumstances that has an effect on the contents of the offer. The prices are given excluding VAT. Statutory tax and other public administration fees are added to the prices. If there are changes in these between the times the offer is given and the delivery of the order, Ariterm shall be entitled to increase its prices by the amount the tax or public administration fee has changed. The buyer’s purchase order becomes binding to Ariterm, when Ariterm has confirmed the purchase order, a separate supply agreement has been signed or the goods have been delivered.
Agreement Formation. No Agreement shall be considered to have been entered into by BCBSKS until all required signatures and certifications have been rendered and a written agreement has been signed by the Parties.
