Aggregated Statistical Information. Acumatica owns the aggregated and statistical data derived from the operation of the Service, including, without limitation, the number of records in the Service, the number and types of transactions, configurations, and reports processed in the Service and the performance results for the Service (the “Aggregated Statistical Information”). Nothing in this Agreement shall be construed as prohibiting Acumatica from utilizing the Aggregated Statistical Information for purposes of providing or improving the Service, benchmarking the Service performance, preparing statistics and system metrics, and marketing; provided however, that Acumatica’s use of Aggregated Statistical Information will not reveal your identity or your Personal Data to any third party.

Aggregated Statistical Information. Workday owns the aggregated and statistical data derived from the operation of the Service, including, without limitation, the number of records in the Service, the number and types of transactions, configurations, and reports processed in the Service and the performance results for the Service (the “Aggregated Statistical Information”). The Aggregated Statistical Information shall not, either alone or in combination with other information, directly or indirectly reveal to any third party and will not be capable of being reverse engineered to reveal to any third party the identity of Customer, Customer’s or Authorized PartiesPersonal Data, or any individual or specific Customer Data entered by any individual into the Service or modified by the Service. In no event will the Aggregated Statistical Information include any Personal Data, Customer Intellectual Property or other Customer Confidential Information. Subject to the above limitations and restrictions in this Section 3.6 (Aggregated Statistical Information), Workday may utilize the Aggregated Statistical Information for purposes of operating Workday’s business.
Aggregated Statistical Information. Pluralsight owns the Aggregated Statistical Information derived from the operation of the Platform. Nothing herein shall be construed as prohibiting Pluralsight from utilizing the Aggregated Statistical Information for purposes of operating Pluralsight’s business, provided that Pluralsight’s use of Aggregated Statistical Information will not reveal personal information to any third party.

This Agreement consists of the provisions set forth below, including provisions of all Attachments referenced herein. In the event of a conflict between the provisions set forth below and those contained in any Attachment, the provisions set forth shall control. The Vendor Agreement shall include and incorporate by reference this Agreement, the terms and conditions, special terms and conditions, any agreed upon amendments, as well as all of the sections of the solicitation as posted, including any addenda and the awarded vendor’s proposal. Once signed, if an awarded vendor’s proposal varies or is unclear in any way from the TIPS Agreement, TIPS, at its sole discretion, will decide which provision will prevail. A Purchase Order, Agreement or Contract is the TIPS Member’s approval providing the authority to proceed with the negotiated delivery order under the Agreement. Special terms and conditions as agreed to between the vendor and TIPS Member should be added as addenda to the Purchase Order, Agreement or Contract. Items such as certificate of insurance, bonding requirements, small or disadvantaged business goals are some of the addenda possible.

The F-test is a 32 comparison of variances to determine if the OV and Quality Acceptance population variances 33 are equal. The t-test is a comparison of means to determine if the OV and Quality Acceptance 34 population means are equal. In addition to these two types of analyses, independent verification 35 and observation verification will also be used to validate the Quality Acceptance test results.
