Common use of Agent May Perform Clause in Contracts

Agent May Perform. If the Grantor fails to perform any agreement contained herein, the Agent may itself perform, or cause performance of, such agreement, and the expenses of the Agent incurred in connection therewith shall be payable by the Grantor under section 16(b). The Grantor assumes all liability and responsibility in connection with the Collateral, and the liability of the Grantor to pay the Obligations shall not be diminished or otherwise affected by reason of any Collateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reason.

Agent May Perform. If the Grantor fails to perform any agreement contained herein, the Agent may but without any obligation to do so and without notice, itself perform, or cause performance of, such agreement, and the expenses of the Agent incurred in connection therewith shall be payable by the Grantor under section 16(b). The Grantor assumes all liability and responsibility in connection with the Collateral, and the liability of the Grantor to pay the Obligations shall not be diminished or otherwise affected by reason of any Collateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reasonSection 12.

The Grantor assumes all liability and responsibility in connection with Grantor; provided that the Collateral, and the liability Agent shall not be required to perform or discharge any obligation of the Grantor to pay and the Obligations performance by the Agent shall not be diminished or otherwise affected by reason waive the rights of any Collateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reasonthe Agent to enforce this Agreement.

The Grantor assumes all liability and responsibility in connection with the Collateral, and the liability of the Grantor to pay the Obligations Grantors; provided that Agent or any other Secured Party shall not be diminished required to perform or otherwise affected by reason discharge any obligation of any Collateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reasonGrantor.

If Upon the occurrence and during the continuance of an Event of Default, if any Grantor fails to perform any agreement contained herein, the Agent may may, but without any obligation to do so and without notice, itself perform, or cause performance of, such agreement, and the expenses of the Agent incurred in connection therewith shall be payable by the such Grantor under section 16(b). The Grantor assumes all liability and responsibility in connection with the Collateral, and the liability of the Grantor to pay the Obligations shall not be diminished or otherwise affected by reason of any Collateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reasonSection 23.

Agent May Perform. If the Grantor fails to perform any agreement contained hereinobligation under or in connection with this Agreement, the Agent may (but shall have no duty to) itself perform, perform or cause performance of, of such agreementobligation, and the expenses of the Agent incurred in connection therewith shall be payable by the Grantor under section 16(b)pursuant to Section 6.4. The Grantor assumes all liability and responsibility in connection with Agent may from time to time take any other action which the CollateralAgent deems necessary or appropriate for the maintenance, and the liability preservation or protection of any of the Grantor to pay the Obligations shall not be diminished Collateral or otherwise affected by reason of any Collateral being uncollectible, lost, destroyed, stolen, damaged or otherwise unavailable for any reasonits security interest therein.
