Common use of Agent May Perform Clause in Contracts

Agent May Perform. If any Grantor fails to perform any agreement contained herein, the Agent may itself perform, or cause performance of, such agreement, and the expenses of the Agent incurred in connection therewith shall be payable by such Grantor pursuant to Section 6.2; provided, however, if any Default of the nature referred to in Section 8.1.9 of the Credit Agreement or Event of Default has occurred and is continuing, no such notice shall be required.

Agent May Perform. (a) If any Grantor fails to perform any agreement contained herein, the Agent may itself perform, or cause performance of, such agreement, and the expenses of the Agent incurred in connection therewith shall be payable by such Grantor pursuant under Section 14(b) hereof to Section 6.2; provided, however, if any Default of the nature referred to in Section 8.1.9 of the Credit Agreement or Event of Default has occurred and is continuing, no such notice shall be requiredfullest extent permitted ------------- by applicable law.
