After Transfer to claim retransfer of the Property from the Purchaser notwithstanding that the Purchaser at such date of cancellation of this agreement, may have paid to the Developer the full purchase price of the Property. The Developer shall in such event refund to the Purchaser the purchase price paid by the Purchaser to the Developer less the reasonable damages sustained by the Developer arising from such cancellation; or cancel the agreement concluded between the Developer and the Purchaser: - and to the extent that the agreement applies after transfer and claim damages suffered due to the Purchaser’s breach, remove from the site, all its tools, equipment, plant and machinery and materials and give its sub-contractors the right to do the same, claim payment of all amounts due from the Purchaser in respect of: - the contract value of the work completed and work in hand; the cost of materials and goods purchased for the Works; the cost of removal of the said tools and materials; the cost of all professionals engaged by the Developer in relation to the Dwelling House; and/or retain all amounts paid on account of liquidated damages without prejudice to its rights to claim further damages; or claim specific performance. Should the Developer take steps against the Purchaser pursuant to a breach by the Purchaser of this agreement, then without prejudice to any other rights which the Developer may have, the Developer shall be entitled to recover from the Purchaser all legal costs incurred by it including attorney/client charges, tracing fees and such collection commission as the Developer is obliged to pay to its Attorneys. Without prejudice to all or any of the rights of the Developer in terms of this agreement, should the Purchaser fail to pay any amount due by the Purchaser in terms of this agreement on due date, then the Purchaser shall pay the Developer interest thereon at the Prime Rate plus 3% calculated from the due date for payment until the actual date of payment, both dates inclusive.
