Common use of Advances by Custodian for Settlement Clause in Contracts

Advances by Custodian for Settlement. The Custodian may, in its sole discretion and from time to time, advance funds to a Trust to facilitate the settlement of a Fund’s transactions in the Fund Custody Account, and the Custodian will endeavor to notify the Trust as promptly as practicable under the circumstances if the Custodian will not cover an overdraft, provided however that failure by the Custodian to so notify shall not impair Custodian’s rights and remedies hereunder. Any such advance shall be repayable immediately upon demand made by Custodian.
