Substitute teachers who have worked thirty (30) days or more during a calendar year and who continue to be available for employment and substitute teachers who replace or are replacing an employee for twenty (20) or more consecutive days are to be included in the bargaining unit. Supervisory personnel shall include the chief administrative officer of the district and all assistant administrative officers and principals. Substitute teachers who have worked thirty (30) or more days during a calendar year and who continue to be available for employment are regular part-time employees and are to be included in the bargaining unit. Substitute teachers who replace or are replacing an employee for twenty (20) or more consecutive days are to be included in the bargaining unit. Substitutes shall not be covered by the provisions of this agreement other than rate of pay. The rate of pay is one hundred ($100) dollars a day. Substitutes after twenty (20) consecutive days will be paid according to their placement on the salary schedule. The Board agrees not to negotiate with or recognize any other certificated employee organization other than the Association for the duration of this agreement. Unless the context in which they are used clearly requires otherwise, words used in this Agreement denoting gender shall include both masculine and feminine.
ADMINISTRATION SECTION A: EXCLUSIVE RECOGNITION. 1. The Board recognizes the Association as the sole and exclusive negotiating representative for all certificated personnel employed by the Board except for the Superintendent, Exempt Administrators, Principals, Vice-Principals and Substitute Teachers. The Board will not negotiate with any "employee organization" as that term is defined in RCW 41.59 except the Association, which has been certified by the Board as representing the certificated employees of the District.

The Parties hereto expressly understand and agree that, for all Tax Years to which this Agreement may apply, the calculation of negative financial consequences will be defined for each applicable Tax Year in accordance with the Applicable School Finance Law, as defined in Section 1.2 above, and that such definition specifically contemplates that calculations made under this Agreement may well periodically change in accordance with changes made from time to time in the Applicable School Finance Law. The Parties further agree that the printouts and projections produced during the negotiations and approval of this Agreement are: (i) for illustrative purposes only, are not intended to be relied upon, and have not been relied upon by the Parties as a prediction of future consequences to either Party to the Agreement; (ii) are based upon current School Finance Law, which is subject to change by statute, by administrative regulation, or by judicial decision at any time; and (iii) may change in future years to reflect changes in the Applicable School Finance Law.
