Administration of Grievances. Due to the certification of the Union as the sole and exclusive bargaining agent for employees covered by the terms of this Agreement, group grievances shall be processed solely by the Union on behalf of an employee or on behalf of a group of employees or the Union itself setting forth name(s) or group(s) of the employee(s). The Union may have the grievant or one grievant representing a group of grievants present at any step of the grievance procedure with the employee being entitled to Union representation at each and every step of the grievance procedure. The resolution of a grievance filed on behalf of a group of employees shall be made applicable to the appropriate employees within that group. It is acknowledged that no individual employee’s grievance may be settled unless the Union is afforded the opportunity to be present at any settlement conference, any settlement shall be consistent with the terms of this Agreement, and that a copy of any settlement shall be provided to the Union. It is also recognized that the union has the right to exercise its discretion to refuse to process and/or appeal unmeritorious grievances and that only the Union may refer a grievance to arbitration.
