The Developer shall construct a wall around the exiting fiber optic utilities along the Interstate 25 Frontage Road to protect them in place (“Utility Wall”). The District shall be responsible for maintaining the Utility Wall and hereby agrees to perform such maintenance. As part of the Civil Engineering Construction Plans, the Developer shall provide approval for the construction of the Utility Wall from the fiber optic utility owners whose utilities will be enclosed by the Utility Wall and from the Colorado Department of Transportation.
