To the extent that the DriveCam End User Terms and Conditions or Surfsight End User License Agreement conflicts with the Contract, the DriveCam End User Terms and Conditions or Surfsight End User License Agreement will control as between Vendor and any Participating Entity, including, without limitation, with respect to the limitations of liability and data rights. Some Participating Entitles may require the use of a Participating Addendum; the terms of which will be worked out directly between the Participating Entity and the Vendor. Any negotiated additional terms and conditions must never be less favorable to the Participating Entity than what is contained in this Contract.
