Common use of Active Military Duty Clause in Contracts

Active Military Duty. Employees who are members of those components listed above and who are called or ordered to military service for longer than one hundred and seventy-six (176) hours for each calendar year, because of an executive order issued by the President of the United States or an act of Congress are entitled, during the period designated in the act or order, to a leave of absence from their respective duties and to be paid each monthly pay period of that leave, the difference between the employer’s gross monthly wage or salary and the sum of the employee’s gross military pay and allowances received that month. No employee will receive payment under this section, if the sum of the employee’s gross military pay and allowances received in the period exceeds the employee’s gross wage or salary. Within ninety (90) days after discharge from Military active duty, the member may be reinstated to his/her former position or a position at a similar level, without loss of seniority. The member shall promptly inform the Police Chief of his/her willingness to return to work, provide proof of honorable discharge, be mentally fit to return to work, and pass a re-employment physical paid for by the Employer.
