Common use of Active Duty Clause in Contracts

Active Duty. Any employee who is drafted or otherwise called to active military duty with the Armed Forces of the United States will be granted military leave. During military leave the employee will receive his/her rate of pay less the amount of compensation, including allowances, received from the military for up to two (2) weeks per year. Upon return from military leave, the rate of pay and other benefits will be the same as if the employee had worked continuously with the District in the assignment held when the period of military leave commenced.

Active Duty. Any employee who is drafted or otherwise called to active military duty with the Armed Forces of the United States will be granted military leave. During military leave the employee will receive his/her rate of pay less the amount of compensation, including allowances, received from the military military, for up the remainder of the school year in which s/he was called to two (2) weeks per yearactive duty. Upon return from military leave, the rate of pay and other benefits will be the same as if the employee had worked continuously with the District in the work assignment held when the period of military leave commenced.
