Acting Capacity Pay. (1) An appointing authority may designate an employee to perform temporary duties in a classification for which the rate of pay is higher than that of the employee's classification for any of the following reasons:

Acting Capacity Pay. 1. Acting capacity pay is paid when an employee is appointed to a different position in a higher non-exempt classification on a temporary basis. An employee who is in acting capacity must meet the minimum qualifications of the position. The effective date for acting capacity pay shall be the date that the employee began performing the higher level duties consistent with Section 2.A above.
Acting Capacity Pay. An employee assigned to perform the duties associated with a classification with a higher rate of pay than that of the employee’s classification shall receive the hourly rate applicable to the higher classification. This higher rate of pay is Acting Capacity Pay. Prior to accepting the acting capacity appointment, the employee will be notified in writing of the duties expected. Acting Capacity Pay shall be paid for the period in excess of five (5) continuous work days. The initial period of Acting Capacity Pay shall be limited to six (6) months or less and may be extended for period up to six (6) months. The performance evaluation of the employee working the duties of a higher pay rate shall reflect the added responsibilities the employee performs. An employee in Acting Capacity shall not be relieved of such capacity prior to the completion of the five-day waiting period for the purpose avoiding Acting Capacity Pay. The College shall not rotate employees in an acting capacity position to avoid acting capacity pay, nor shall employees be recurrently scheduled in an acting capacity position without compensation. An employee shall not be required to accept an acting capacity assignment if he/she would suffer a loss in pay. Acting Capacity appointments are voluntary. No employee shall be disciplined or retaliated against for rejecting an opportunity to work in an acting capacity appointment. Employees who do not satisfactorily perform the required elements of the higher classification shall be returned to their position instead of suffering formal disciplinary action.
Acting Capacity Pay. An employee who is required to perform in a position that is a higher level position in the bargaining unit than that of the employee’s current position shall be paid additional compensation after twenty-two (22) consecutive work days from the first day the employee started working in the higher level position. The amount of acting capacity pay shall be 6% higher than the employee’s current salary. Acting capacity shall be paid on an hour for hour basis. The original period of acting capacity shall be no more than six (6) months. For operational reasons, the employee may be assigned to an additional six (6) months extension. Acting capacity may not exceed twelve (12) months.
Acting Capacity Pay. When employees are placed in a Temporary Assignment or an Acting Appointment, duration, salary adjustments, if any, and other terms and conditions regarding the Assignment or Appointment shall be treated by the University consistent with USM Policy VII-9.50 Policy on Temporary Assignments and Acting Appointments applicable to Nonexempt employees, and USM Policy and Procedures VII – 9.11 (A)(2)(C) except as modified below,

However, where the employee is in an Acting Appointment which is considered to be in a Pay Range which is two (2) or more Pay Ranges higher than the Pay Range of the employee’s normal appointment, the employee will receive a twelve percent (12%) increase (or the minimum of the pay range, whichever is higher) for the period of the Acting Capacity assignment, subject to all the other provisions of USM Policy VII-9.50.
Acting Capacity Pay. A. Acting capacity pay shall be approved on an hour to hour basis after the employee has been in the position for thirty (30) days and may continue for a maximum period of twelve (12) months. Additional extensions are allowed based on the legitimate operational needs of the University; however, after a UPO has been in acting capacity for the maximum period, another UPO must be identified for any subsequent extensions. No UPO shall function in acting capacity for longer than twelve (12) months.

Acting Capacity Pay. An employee required to perform the duties of a position in a classification that has a rate of pay which is higher than that of the employee's classification shall be paid additional compensation on the 21st consecutive calendar day of work in the acting capacity, retroactive to the first day stated in writing that the employee served in official acting capacity. In the event there is a vacancy that is anticipated to exceed thirty (30) consecutive calendar days the employee shall be paid acting capacity pay from the first day the employee started working in the higher classification. The amount of acting capacity pay shall be at least 6% higher than the employee's current salary but not more than the maximum pay for the salary range. Employees shall receive duty days and accrual of leave rates commensurate with the position. The University may appoint any employee with the requisite experience and requirements of the position, to an acting capacity status in order to meet operational needs when time or circumstances do not permit the immediate selection of a replacement. When an employee is appointed to or actually serving in an acting capacity he/she shall be eligible to receive the hourly rate of pay applicable to the higher classification but not less than the minimum of the salary grade. The University shall not rotate employees in and out of an acting capacity position in order to avoid the payment of acting capacity pay to one employee. Upon conclusion of the acting appointment, the employee’s salary shall revert to the employee’s last regular salary rate in effect prior to the acting capacity. Acting capacity appointments shall be voluntary and no employee shall be disciplined or retaliated against for rejecting an opportunity to work in an acting capacity appointment. Prior to accepting the acting capacity appointment, the employee shall be provided a job description of expected duties. The performance evaluation of the employee working the duties of a higher pay rate shall reflect the added responsibilities the employee performs. Employees who do not satisfactorily perform the required duties of the higher classification shall be returned to their previous position and shall not suffer formal disciplinary action, unless the employees conduct or actions warrant such disciplinary action. This higher rate of pay is Acting Capacity Pay. Acting Capacity Pay shall be paid after the employee has worked no less than 20 work days in the acting pay position. On the 21st day of working in an acting capacity position an employee shall be paid at the higher rate of pay. The initial period of Acting Capacity Pay shall be limited to six (6) months or less and may be extended for a period up to an additional six (6) months.‌
Acting Capacity Pay. An employee designated by the appointing authority to perform on a temporary basis, for any length of time greater than thirty (30) consecutive days per calendar year, the duties of a position in a classification with the pay range which is higher than that of the employee’s classification shall be paid additional compensation. The amount of acting capacity pay shall be six percent (6%) more than the current pay, or the minimum of the pay range for the new classification, whichever is greater. Upon the conclusion of acting capacity duties, the employee’s salary reverts to that earned before acting capacity, plus any COLA or merit pay adjustments that apply to the employee’s original salary.
