(a) It is in the mutual interests of the parties to promote health and safety in the workplace and to prevent and reduce the occurrences of workplace injuries and occupational diseases. The Employer parties agree that employees have the right to a safe and healthy work environment and that health and safety is of the utmost importance. The parties agree to promote health and safety and The Hospital shall provide orientation and training in health and safety to new and current employees on a ongoing basis and employees shall attend required health and safety training sessions. The parties fully endorse the responsibilitiesof employer and employee under the Occupational Health and Safety Act. Accordingly, the provisions of the Occupational Health and Safety Act are incorporated into and form part of this CollectiveAgreement and the Union agree that they mutually desire rights and responsibilities set out therein will not be diminished. The Hospital agrees to maintain standards of safety cooperate in providing necessary information and health in management support to enable the Health and Safety Committee to fulfil its functions. In addition, the Hospital will provide the Health and Safety Committee with access to all accident reports, health and safety records and other pertinent information in order its’ possession. The Health and Safety Committee shall respect the confidentiality of the information. Where the Hospital determines there is a risk that employees may be exposed to prevent accidentsinfectious or communicable diseases (viral or bacterial), injury or blood pathogens, employeeswho may be so exposed will be provided with personal protective equipment reasonably necessaryfor the protection of the employee. An employee who is required by the Hospital to wear or use any protective clothing, equipment or device shall be instructed and illnesstrained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the employee shall participate in such instruction and training. its Where the Hospital identifies high risk areas where employees are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employee. The following shall be recognized as paid statutory, civic, or government holidays : New Year's Day Civic Holiday *Heritage Day (see note Labour Day below) Thanksgiving Day Good Friday Christmas Day Easter Monday Boxing Day Victoria Day Dominion Day *Each employee shall be entitled to one additional holiday with pay each year. This day will be the third Monday in February unless the Government declares Heritage Day as a paid holiday at which time that would then become the Paid Holiday in the Collective Agreement. All employees are granted one additional day annually conjunction with anniversary date of employment. This a day to be provided by the Hospital within sixty (60) days after the actual anniversary date. In order to qualify for payment for the above named holidays under the provisions of this Agreement, an employee must work the employee's last scheduled shift immediately before the holiday and his first scheduled shift immediately after the holiday. The Hospital further agrees to meet directly with the representative of the Union or through the Accident Prevention to the need for any protective clothing or safety equipment in addition to that which the Hospital is presently providing, Effective September and on that date for each sub- sequent year, the Hospital will provide per year to each full-time employee who is required by the Hospital to wear safety footwear during the course of his duties.

PAID HOLIDAYS The following holidays shall be recognized by the Hospital as paid holidays: New Year's Day Labour Day Good Friday Thanksgiving Day Easter Monday Christmas Day Victoria Day Boxing Day Canada Day Floating Holiday August Civic Holiday Remembrance Day The. Floating Holiday may be taken at any time during the twelve (12) consecutive months following the qualifying date on a day mutually agreed upon between the employee and his Department Head. In order to qualify for the holiday an employee must be in the employ of the Hospital on March each year. In the event Heritage Day or some other day is proclaimed as a statutory holiday by the Government of the Province of Ontario for the term of this contract the said day will continue to be a float day. VACATIONS

Accident Prevention Health and Safety Committee. It is in the mutual interests of the parties to promote health and safety in the workplace and to prevent and reduce the occurrence of workplace injuries and occupational diseases. The parties agree that employees have the right to a safe and healthy work environment and that health and safety is of the utmost importance. The parties agree to promote health and safety and The Hospital shall provide orientation and training in health and safety to new and current employees on an ongoing basis and employees shall attend required health and safety training sessions. The parties fully endorse the responsibilitiesof employer and employee under the Occupational Health and Safety Act. Accordingly, the provisions of the Occupational Health and Safety Act are incorporated into and form part of this collective agreement and the rights and responsibilitiesset out therein will not be diminished. The Hospital agrees to cooperate in providing necessary information and management support to enable the Health and Safety Committee to fulfill its functions. In addition, the Hospital will provide the Health and Safety Committee with access to all accident reports, health and safety records and other pertinent information in its possession. The Health and Safety Committee shall respect the confidentiality of the information. Where the Hospital determines that there is a risk that employees may be exposed to infectious communicable diseases (a) viral or bacterial), or blood borne pathogens, employees who may be so exposed will be provided with personal protective equipment reasonably necessary for the protection of the employee. An employee who is required by the Hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the employee shall participate in such instruction and training. Where the Hospital identifies high risk areas where employees are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employee. The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the Hospital in order to prevent accidents, injury and illness. Recognizing its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of its Accident Prevention Health and Safety Committee at least one representative selected or appointed by the Union from amongst the full-time or the part-time bargaining unit employees. The Union agrees to appoint one regular member and one alternate member in order to ensure continuous representation on this committee at all times. Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. The Hospital agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfil its functions. Meetings shall be held every second month month, or more frequently at the call of the Chair chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. Subject to the requirements of patient care, the Hospital agrees to stop work and provide a minute of silence for all employees at I A.M. April in memory of workers killed or injured on the job. The announce on its public address system at a.m., April that all employees will be observing a minute of silence in memory of workers killed or injured in the job.

The Hospital will require employees may request the following functions to be transferred from their current duties ifwear appropriate Engineering Services; Grounds; Transport; (only where frequently working in storage areas). (as determined by the Hospital) heavy carts on a regular basis, in e.g., linen carts, food wagons. Accident Prevention Health and Safety Committee. The Hospital agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. In addition, the Hospital will provide the Committee with reasonable access to all accident reports, health and safety records and any other pertinent information in its possession. Meetings shall be held every second month or more frequently at the call of the Chair Chair, if required. The Committee shall maintain minutes of all meetings and make the same available for review. Any representative appointed or selected in accordance with hereof hereof, shall serve for a term of at least one calendar year from the date of which may be renewed for further periods of one year. Time off for such representative(s) to attend meetings of the Accident Prevention Health and Safety Committee in accordance with the foregoing foregoing, shall be granted and time so spent any representative(s) attending such meetings during their regularly scheduled hours of work, shall be deemed to be work time for which the representative(s) shall be paid by the Hospital at his not lose regular or premium rate earnings as may be applicablea result of such attendance. Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's ’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave referred to in Article leave. Where the Hospital identifies high risk areas where employees nurses are exposed to Hepatitis the Hospital will provideinfectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employeesnurses. NOTE: Issues relating to chairing of meetings and responsibility for the taking of minutes should be discussed locally with the Hospital and the other Unions representing employees of the Hospital.
