Common use of Access to Protected Health Information Clause in Contracts

Access to Protected Health Information. At the direction of the Covered Entity, the Business Associate agrees to provide access, in accordance with 45 CFR 164.524, to any Protected Health Information held by the Business Associate, which Covered Entity has determined to be part of Covered Entity’s Designated Record Set, in the time and manner designated by the Covered Entity. This access will be provided to Covered Entity, or (as directed by Covered Entity) to an Individual, in order to meet requirements under the Privacy Rule.

This access will be provided to Covered EntityEntity or, or (as directed by Covered Entity) , to an Individual, in order to meet requirements under the Privacy Rule.

At Business Associate shall provide access, at the direction request of the Covered Entity, the Business Associate agrees to provide access, in accordance with 45 CFR 164.524, to any Protected Health Information held by the Business Associate, which Covered Entity has determined to be part of Covered Entity’s Designated Record Set, in a designated record set (as defined in the time and manner designated by the Covered Entity. This access will be provided Privacy Rule), to Covered Entity, or (as directed by Covered Entity) , to an Individual, individual in order to meet the requirements under of 45 C.F.R. § 164.524. If an individual makes a request for access pursuant to 45 C.F.R. § 164.524 directly to Business Associate, or inquiries about his or her right to access, Business Associate will either forward such request to Covered Entity or direct the Privacy Ruleindividual to Covered Entity.
