Common use of Access to List of Certificateholders' Names and Addresses Clause in Contracts

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. The Certificate Registrar shall furnish or cause to be furnished to the Servicer and the Depositor, or to the Indenture Trustee or the Owner Trustee, within fifteen (15) days after receipt by the Certificate Registrar of a written request therefor from the Servicer, the Depositor or the Indenture Trustee or the Owner Trustee, as the case may be, a list, in such form as the requesting party may reasonably require, of the names and addresses of the Certificateholders as of the most recent Record Date. If three or more Certificateholders and/or or one or more Holders of Certificates evidencing not less than 25% of the aggregate Certificate Owners (a) request such information Percentage Interest apply in writing from to the TrusteeCertificate Registrar, (b) state and such application states that such Certificateholders and/or Certificate Owners the applicants desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Trust Agreement or under the Certificates, Certificates and (c) provide such application is accompanied by a copy of the communication which that such Certificateholders and/or Certificate Owners applicants propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten five (5) Business Days after the receipt of such requestapplication, (x) provide afford such applicants access during normal business hours to the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent current list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry CertificatesCertificateholders. The Depositor and every Certificateholder and Certificate OwnerEach Certificateholder, by receiving and holding a Certificate, shall be deemed to have agreed not to hold any of the Depositor, the Certificate Registrar or beneficial interest therein, agree that the Owner Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunderits name and address, regardless of the source from which such information was derived.

If three or more Certificateholders and/or Certificate Owners Certificateholders, a Certificateholder holding all the Certificates of any Class of Certificates, the Master Servicer, the Special Servicer, the Paying Agent, the Trustee, the Operating Adviser or the Depositor (aA) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (B) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten Business Days after the receipt of such request, (x) provide afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, the Master Servicer Paying Agent, the Trustee or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Operating Adviser, as applicable, access during normal business hours to a current list of the Certificateholders Certificateholders. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that the Certificate or beneficial interest therein, agree that Registrar and the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

If three or more Certificateholders and/or Certificateholders, or in the case of Book-Entry Certificates, Certificate Owners (a) request such information in writing from the TrusteeSecurities Administrator, (b) state that such Certificateholders and/or or Certificate Owners desire to communicate with other Certificateholders and/or or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which that such Certificateholders and/or or Certificate Owners propose to transmit, transmit or if the Depositor or the Master Servicer shall request such information in writing from the TrusteeSecurities Administrator, then the Trustee Securities Administrator shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' ’ expense the most recent list of the Certificateholders of such the Trust Fund held by the TrusteeSecurities Administrator, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest thereinCertificate, agree that the Trustee Securities Administrator shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners Certificateholders, a Certificateholder holding all the Certificates of any Class of Certificates, the Master Servicer, the Special Servicer, the Trustee, the Operating Adviser or the Depositor (aA) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (B) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten Business Days after the receipt of such request, (x) provide afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, the Master Servicer Trustee or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Operating Adviser, as applicable, access during normal business hours to a current list of the Certificateholders Certificateholders. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that the Certificate or beneficial interest therein, agree that Registrar and the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

If three or more Certificateholders and/or or Certificate Owners (ai) request such information in writing from the Trustee, (bii) state that such Certificateholders and/or or Certificate Owners desire to communicate with other Certificateholders and/or or Certificate Owners with respect to their rights under this Agreement or under the Certificates, Certificates and (ciii) provide a copy of the communication which such Certificateholders and/or or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (xa) provide the Depositor, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' ’ expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (yb) assist the Depositor, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' ’ expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or or Depository Participants hereunder, regardless of the source from which such information was derived.

If three or more Certificateholders and/or Certificate Owners (a) If any three (3) or more Certifying Certificateholders, the Master Servicer, the Special Servicer, the Certificate Administrator, the Trustee, the Trust Advisor, or the Depositor (i) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (ii) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten (10) Business Days after the receipt of such request, (x) provide at no cost to such requesting party, afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, the Master Servicer Certificate Administrator, the Trustee or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Trust Advisor, as applicable, access during normal business hours to a current list of the Certificateholders of such Trust Fund held by the Trusteeor, if anyrequested, and (y) assist shall provide such list electronically to the Depositorapplicable requesting party; provided, that the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from Registrar shall not be required to determine the Depository a list identity of the related Depository Participants acting on behalf any Certificate Owner of Certificate Owners of Book any Book-Entry CertificatesCertificate. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that none of the Certificate or beneficial interest thereinRegistrar, agree that the Master Servicer, the Special Servicer, the Certificate Administrator, the Depositor, the Trustee or the Trust Advisor shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer Depositor or such Certificateholders and/or Certificate Owners at such recipients' ’ expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer Depositor or such Certificateholders and/or Certificate Owners at such recipients' ’ expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Book-Entry Certificates. The Depositor and every Certificateholder and and/or Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) If any three (3) or more Certifying Certificateholders, the Master Servicer, the Special Servicer, the Certificate Administrator, the Trustee, the Trust Advisor, or the Depositor (i) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (ii) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten (10) Business Days after the receipt of such request, (x) provide at no cost to such requesting party, afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, the Master Servicer Certificate Administrator, the Trustee or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Trust Advisor, as applicable, access during normal business hours to a current list of the Certificateholders of such Trust Fund held by the Trusteeor, if anyrequested, and (y) assist shall provide such list electronically to the Depositorapplicable requesting party; provided that, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from Registrar shall not be required to determine the Depository a list identity of the related Depository Participants acting on behalf any Certificate Owner of Certificate Owners of Book any Book-Entry CertificatesCertificate. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that none of the Certificate or beneficial interest thereinRegistrar, agree that the Master Servicer, the Special Servicer, the Certificate Administrator, the Depositor, the Trustee or the Trust Advisor shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor Depositor, the Group I Senior Certificate Insurer (with respect to Group I) or the Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten three Business Days after the receipt of such request, (x) provide the Depositor, the Group I Senior Certificate Insurer (with respect to Group I), the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerCertificateholder, by receiving and holding a Certificate or beneficial interest thereinCertificate, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor Depositor, the Certificate Insurer or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Certificate Insurer, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' ’ expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Certificate Insurer, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' ’ expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Book-Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or or Certificate Owners (ai) request such information in writing from the Trustee, (bii) state that such Certificateholders and/or or Certificate Owners desire to communicate with other Certificateholders and/or or Certificate Owners with respect to their rights under this Agreement or under the Certificates, Certificates and (ciii) provide a copy of the communication which such Certificateholders and/or or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (xa) provide the Depositor, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (yb) assist the Depositor, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the 76 Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders and/or Certificate Owners of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest thereinCertificate, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants Certificate Owners hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the 109 Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. The Certificate Registrar shall furnish or cause to be furnished to the Servicer, within 15 days after receipt by the Certificate Registrar of a written request therefor from the Servicer, a list, in such form as the Servicer may reasonably require, of the names and addresses of the Certificateholders as of the most recent Record Date. If three or more Certificateholders and/or Certificate Owners or holders of Investor Certificates evidencing not less than 25% of the aggregate Percentage Interests of any Class (ahereinafter referred to as "Applicants") request such information apply in writing from to the Securitization Trustee, (b) state and such application states that such Certificateholders and/or Certificate Owners the Applicants desire to communicate with other Investor Certificateholders and/or Certificate Owners with respect to their rights under this Securitization Trust Agreement or under the Certificates, Certificates and (c) provide such application is accompanied by a copy of the communication which that such Certificateholders and/or Certificate Owners Applicants propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Securitization Trustee shall, within ten five Business Days after the receipt of such requestapplication, (x) provide afford such Applicants access, during normal business hours, to the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent current list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry CertificatesInvestor Certificateholders. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate or beneficial interest thereinCertificate, agree agrees with the Servicer and the Securitization Trustee that neither the Servicer nor the Securitization Trustee shall not be held accountable by reason of the disclosure of any such information as to the list names and addresses of the Certificateholders and/or Depository Participants hereunderunder the Agreement, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to 87 their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or 103 Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners Certificateholders, a Certificateholder holding all the Certificates of any Class of Certificates, the Master Servicer, the Special Servicer, the Operating Adviser or the Depositor (aA) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (B) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten Business Days after the receipt of such request, (x) provide the Depositorafford such Certificateholders, the Master Servicer Servicer, the Special Servicer, the Depositor or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Operating Adviser, as applicable, access during normal business hours to a current list of the Certificateholders Certificateholders. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that the Certificate or beneficial interest therein, agree that Registrar and the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such Trust Fund held by the 106 Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners Certificateholders, a Certificateholder holding all the Certificates of any Class of Certificates, the Master Servicer, the Special Servicer, the Operating Adviser or the Depositor (aA) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (B) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights 60 68 under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten Business Days after the receipt of such request, (x) provide afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, or the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Operating Adviser, as applicable, access during normal business hours to a current list of the Certificateholders Certificateholders. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that the Certificate or beneficial interest therein, agree that Registrar and the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificateholders, or in the case of Book-Entry Certificates, Certificate Owners (a) request such information in writing from the TrusteeSecurities Administrator, (b) state that such Certificateholders and/or or Certificate Owners desire to communicate with other Certificateholders and/or or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which that such Certificateholders and/or or Certificate Owners propose to transmit, transmit or if the Depositor Depositor, the Insurer or the Master Servicer shall request such information in writing from the TrusteeSecurities Administrator, then the Trustee Securities Administrator shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Insurer, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' ’ expense the most recent list of the Certificateholders of such the Trust Fund held by the TrusteeSecurities Administrator, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest thereinCertificate, agree that the Trustee Securities Administrator shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners Certificateholders, a Certificateholder holding all the Certificates of any Class of Certificates, the Master Servicer, the Special Servicer, the Paying Agent, the Trustee, the Operating Adviser or, in the case of the Class LF Certificates, the Lakeforest Mall Mortgage Loan Operating Adviser, or the Depositor (aA) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (B) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten Business Days after the receipt of such request, (x) provide afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, the Master Servicer Paying Agent, the Trustee or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Operating Adviser or, in the case of the Class LF Certificates, the Lakeforest Mall Mortgage Loan Operating Adviser, as applicable, access during normal business hours to a current list of the Certificateholders Certificateholders. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that the Certificate or beneficial interest therein, agree that Registrar and the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or Certificate Owners Certificateholders, a Certificateholder holding all the Certificates of any Class of Certificates, the Master Servicer, the Special Servicer, the Paying Agent, the Trustee, the Operating Adviser or, in the case of the Class MM-NA Certificates, the Monmouth Mall Mortgage Loan Operating Adviser, or the Depositor (aA) request such information in writing from the TrusteeCertificate Registrar a list of the names and addresses of Certificateholders and (B) in the case of a request by Certificateholders, (b) state that such Certificateholders and/or Certificate Owners desire to communicate with other Certificateholders and/or Certificate Owners with respect to their rights under this Agreement or under the Certificates, and (c) provide a copy of the communication which such Certificateholders and/or Certificate Owners propose to transmit, or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee Certificate Registrar shall, within ten Business Days after the receipt of such request, (x) provide afford such Certificateholders, the Master Servicer, the Special Servicer, the Depositor, the Master Servicer Paying Agent, the Trustee or such Certificateholders and/or Certificate Owners at such recipients' expense the most recent Operating Adviser or, in the case of the Class MM-NA Certificates, the Monmouth Mall Mortgage Loan Operating Adviser, as applicable, access during normal business hours to a current list of the Certificateholders Certificateholders. The expense of providing any such Trust Fund held information requested by such Person shall be borne by the party requesting such information and shall not be borne by the Certificate Registrar or the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and Certificate OwnerEvery Certificateholder, by receiving and holding a Certificate, agrees that the Certificate or beneficial interest therein, agree that Registrar and the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

Access to List of Certificateholders' Names and Addresses. If three or more Certificateholders and/or or Certificate Owners (a) request such information in writing from the Trustee, (b) state that such Certificateholders and/or or Certificate Owners desire to communicate with other Certificateholders and/or or Certificate Owners with respect to their rights under this Agreement or under the Certificates, Certificates and (c) provide a copy of the communication which that such Certificateholders and/or or Certificate Owners propose to transmit, transmit or if the Depositor or Master Servicer shall request such information in writing from the Trustee, then the Trustee shall, within ten Business Days after the receipt of such request, (x) provide the Depositor, the Master Servicer or such Certificateholders and/or or Certificate Owners at such recipients' expense the most recent list of the Certificateholders of such the Trust Fund held by the Trustee, if any, and (y) assist the Depositor, the Master Servicer or such Certificateholders and/or Certificate Owners at such recipients' expense with obtaining from the Depository a list of the related Depository Participants acting on behalf of Certificate Owners of Book Entry Certificates. The Depositor and every Certificateholder and or Certificate Owner, by receiving and holding a Certificate or beneficial interest thereinCertificate, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.. 120

The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.

The Depositor and every Certificateholder and Certificate Owner, by receiving and holding a Certificate or beneficial interest therein, agree that the Trustee shall not be held accountable by reason of the disclosure of any such information as to the list of the Certificateholders and/or Depository Participants hereunder, regardless of the source from which such information was derived.
