Access to Equipment. DISTRICT representatives shall at all times have access to inspect the CONTRACTOR’S buses and documents to be used for transportation of DISTRICT students. Inspection may include the visual examination of the equipment and examination of bus driver’s licenses/certificates. The DISTRICT reserves the right to reject a trip from departing from a school site or any other location when it is determined the bus and/or the licenses or certificates do not meet the minimum requirements under California law or DISTRICT standards.

If Philips cannot locate the Equipment, or the Equipment is not made available for planned maintenance when scheduled, Philips will notify Customer to reschedule a mutually agreeable day and time for the service. Customer’s failure to make equipment available a second time may constitute Customer’s waiver of the scheduled planned maintenance and shall release Philips from its obligations under the Agreement without any liability. Customer agrees to pay Philips at the then-current demand service rates for the time that Philips’ or its subcontractor’s personnel waits for access to the Equipment.

Access to Equipment. Seller shall have full, free and safe access to the Equipment on each scheduled inspection or emergency service visit. Seller shall also have access to and use of any machine, service, attachments, features, or other operating supplies or accessories necessary to perform the necessary service contemplated herein at no charge to the Seller. Should the Seller be denied access to the Equipment by the Buyer at the agreed upon time, a charge equal to the waiting period times the prevailing Field Engineer hourly rate will be assessed by the Seller and accepted by the Buyer.
