Access by Secretary. DBI shall make available to the Secretary DBI’s internal practices, books and records (including its policies and procedures) relating to the safeguards established by DBI with respect to Electronic Protected Information for the purpose of enabling the Secretary to assess DBI and/or the Plan’s compliance with the Security Rule. DBI shall inform the Privacy Official of any request sent by the Secretary on behalf of the Plan that is received by DBI, unless DBI is prevented by applicable law from doing so.

Access by Secretary. Business Associate shall provide access to its internal practices, books, and records relating to the use and disclosure of Protected Health Information received from, or created or received on behalf of, Covered Entity. Said access shall be given to the Secretary for the purposes of the Secretary determining Covered Entity’s compliance with HIPAA. Nothing in this Section shall be construed as a waiver of any legal privilege or of any protections for trade secrets or confidential commercial information. Business Associate shall immediately notify Covered Entity of such request from the Secretary pertaining to an investigation of Covered Entity’s compliance with HIPAA.
