Common use of Acceptance of Agency Clause in Contracts

Acceptance of Agency. The Unit Agent hereby accepts the agency established by this Unit Agreement and agrees to perform the same upon the terms and conditions herein set forth and among other things, shall account promptly to the Company with respect to Units separated.

Acceptance of Agency. The Each of the Unit Agent and the Warrant Agent hereby accepts the agency established by this Unit Agreement and agrees to perform the same upon the terms and conditions herein set forth and among other things, shall account promptly to the Company with respect to Units separatedforth.

Acceptance of Agency. The Unit Agent hereby accepts the agency established by this Unit Agreement and agrees to perform the same upon the terms and conditions herein set forth and among other things, shall account promptly to the Company with respect to Units separatedexercised and concurrently account for, and pay to the Company, all moneys received by the Unit Agent for the purchase of shares of the Company’s Common Stock through the exercise of Units.

The Unit Warrant Agent hereby accepts the agency established by this Unit Warrant Agreement and agrees to perform the same upon the terms and conditions herein set forth and and, among other things, shall account promptly to the Company with respect to Units separatedUnit Warrant exercised and concurrently account for, and pay to the Company, all moneys received by the Unit Warrant Agent for the purchase of Shares of the Company’s Common Stock through the exercise of Unit Warrant.
