You agree that in using the App, Website and the Invstr Software, you will:

Acceptable Use of the Services. Company agrees that it will not (a) modify, copy, decompile, disassemble or reverse engineer, or cause any other party to modify, copy, decompile, disassemble or reverse engineer, ECHEZ’s Intellectual Property; (b) sublicense any of ECHEZ’s Intellectual Property to third parties or sell, resell, rent, sublicense or lease the Services to third parties; (c) otherwise violate the license grant or restrictions set forth in Section 8 above; (d) use the Services for malicious or unauthorized purposes; (e) interfere with or disrupt the integrity or performance of the Services, ECHEZ operations, or third-party data contained therein either directly or using third party technology ; (g) alter, copy, move or delete any tags or code placed as part of the Services; (h) use or permit, enable or assist any third party to use, the Services to create competing products or services.

Acceptable Use of the Services. The Client must use the Services in accordance with this Agreement and in accordance with all applicable laws. The Client must not attempt to breach or circumvent Platform security. In addition, the Client must not use the Services in any fashion that would, or assist others to: mislead or deceive; post or transmit information that infringes or violates the rights of a third party, including the rights of privacy and publicity; cause or knowingly facilitate the spread of a virus, worm, Trojan horse, or another harmful object; post or transmit unsolicited messages, junk mail, spam or chain letters or material that might be considered offensive; collect or store personal data without permission; promote in any way illegal or unwelcome or unsociable activities; attempt to breach or circumvent Platform security; assist BidContender competitors; or undertake promotions or undertake commercial activity not connected with the business purposes the Services are intended to support. In order to provide the Services effectively and in accordance with applicable law and this Agreement, BidContender may monitor and record the Client’s use of the Services and the Client authorizes BidContender to collect, store and use all such information provided BidContender complies with Section 6.
Acceptable Use of the Services. Neither you nor your End-Users may use the Services for any purpose identified in the Acceptable Use Policy, which is incorporated herein by reference as if fully stated herein. We reserve the right to immediately terminate your Services, or those of your End-Users if, in our sole and absolute discretion, we determine that your or such End-Users have used the Service or the Device for an unlawful or restricted purpose. If we believe that you or your End-Users have used the Service for an unlawful purpose, we may forward the relevant communication and other information, including your identity or that of your End-User, to the appropriate authorities for investigation and prosecution. You hereby consent to our forwarding of any such communications and information to these authorities. In addition, Back9 Networks will provide information in response to law enforcement requests, subpoenas, court orders, to protect it’s rights and property and in the case where failure to disclose the information may lead to imminent harm to the customer or others.
Acceptable Use of the Services. You agree that you will not use the Services to do any of the following or take action that results in any of the following: ● Making defamatory statements regarding Users, other persons, or entities, or using the Services in a commercially unreasonable manner or in any manner that would harm or disparage Summit or the Services; ● Doing anything or posting information that is abusive, harmful, threatening, harassing, defamatory, bullying, stalking, or otherwise objectionable; ● Doing anything unlawful, deceptive, misleading, illegal, unethical, malicious, or discriminatory, obscene, hateful, or sexually-explicit; ● Degrading others on the basis of gender, race, class, ethnicity, national origin, religion, sexual preference, orientation or identity, disability, or other classification or otherwise posting or approving content that: is hate speech, discriminating, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence; ● Violating a person’s right to privacy or publicity or otherwise collecting, using, or disclosing data, including personal information, about other Users without consent or for unlawful purposes in violation of any applicable international, federal, state or local law, statute, ordinance or regulation (“Law”); ● Infringing on, misappropriating or otherwise violating the copyright, trademark, patent or other intellectual property right of any person, including rights in content available through the Services without prior written permission of Summit or the User, as applicable; ● Collecting, soliciting, or otherwise obtaining login information or accessing an account belonging to someone else; ● Accessing (or attempting to access) any service on the Services by any means other than as permitted in this Agreement or operating the Services on any computers or accounts on which you do not have permission to operate; In essence….In order to ensure everyone has a great experience with the Service, please follow our acceptable use policies. Any violation of the AUP or conduct that Service Provider, in its reasonable discretion, believes may subject Service Provider to civil or criminal litigation or liability, charges and/or damages will be considered to be a breach of this Agreement for which Service Provider may, in addition to any other available remedies, suspend or terminate any Service. If Service Provider suspends any Service pursuant to this Section, Service Provider may require a reinstatement fee in order to resume Service.
