Ability to Earn Livelihood. Executive expressly agrees and acknowledges that the covenants and restrictions contained in Section 8 do not preclude Executive from earning a livelihood, nor do they unreasonably impose limitations on Executive's ability to earn a living. In addition, Executive agrees and acknowledges that the potential harm to the Employer of its non-enforcement outweighs any harm to the Executive of its enforcement by injunction or otherwise.
Ability to Earn Livelihood. Consultant represents that his experience and capabilities are such that the provisions of this Article 7 will not prevent him from earning his livelihood, and acknowledges that it would cause the Corporation serious and irreparable injury and cost if Consultant were to use his ability and knowledge in competition with the Corporation or to otherwise breach the obligations contained in Article 7.
Ability to Earn Livelihood. The Officer expressly acknowledges: (i) that he will be able to earn a livelihood without violating the covenants set forth in this Agreement, and (ii) that his ability to do so was a condition precedent to the Company’s entering into this Agreement.
Ability to Earn Livelihood. Employee acknowledges that (i) in the event his employment with Employer terminates for any reason, he will be able to earn a livelihood without violating the foregoing restrictions; and (ii) that his ability to earn a livelihood without violating such restrictions is a material condition to his employment with Employer.

Executive expressly agrees and acknowledges that the Restrictions contained in this Article II do not preclude Executive from earning a livelihood, nor does it unreasonably impose limitations on Executive’s ability to earn a living. In addition, the Executive agrees and acknowledges that the potential harm to the Company and its affiliates of its non-enforcement outweighs any harm to the Executive of its enforcement by injunction or otherwise.
Ability to Earn Livelihood. Consideration. Owners expressly agree and acknowledge that the post-transaction restrictions contained in this Agreement and the respective Employment Agreements do not preclude any Owner from earning a livelihood, nor do they unreasonably impose limitations on such Owner’s ability to earn a living. Each Owner further agrees and acknowledges that the potential harm to the Buyer and to the Designated Subsidiary of the non-enforcement of these restrictions outweighs any harm to the applicable Owner of the enforcement of the restrictions by injunction or otherwise.
Ability to Earn Livelihood. Following termination of Executive’s employment by Company for whatever reason, Company acknowledges that Executive may accept employment in a similar position within Company’s industry. In such event Executive agrees not to utilize Company Secrets in such employment nor shall executive solicit or employ Company employees or solicit Company customers for the timeframes set forth herein. Executive expressly agrees and acknowledges that the restrictions contained in this Section do not preclude Executive from earning a livelihood, nor does it unreasonably impose limitations on Executive’s ability to earn a living. In addition, Executive agrees and acknowledges that the potential harm to the Company of Executive’s breach of its obligations hereunder entitles the Company to enforce the terms hereunder by injunction or otherwise.
