00 - MANAGEMENT RIGHTS. 3.01 It is the Employer's right to operate and manage its business in all respects in accordance with its responsibilities and commitments. The location of jobs, the choice of equipment, the schedule of installation, the methods and means of installation, are solely and exclusively the responsibility of the Employer.

00 - MANAGEMENT RIGHTS. The Union recognizes that the Employer has the sole and exclusive right, except as otherwise specifically limited by the provisions of the Agreement, to determine all matters pertaining to the conduct of its management of The Banff Centre, its affairs, and the direction of the Employer’s work force. The Employer retains all rights not expressly limited by the terms of this Agreement. Such rules and regulations established by these rights shall not be inconsistent with this Agreement.

These rights shall not be limited except as specified in this agreement.
00 - MANAGEMENT RIGHTS. 3.08 (a) In addition to Article 3.05, specific to the Province of Newfoundland and Labrador, the Employer shall have the right to name hire fifty percent (50%) of the crew unless otherwise is mutually agreed to between the Employer and the Union. In no case shall there be in excess of fifty percent (50%) name hires on a crew at any given time unless mutually agreed to between the Employer and the Union. Notwithstanding Master Portion 3.08(c), on jobsites with multiple contracts, the Employer may name hire pursuant to Master Portion Article 3.08(a) and transfer between contracts pursuant to Master Portion 3.08(a).
00 - MANAGEMENT RIGHTS. 3.01 Without restricting the generality of the following, the Union recognizes the right of the Employer to manage his company, direct the work forces, assign work, transfer employees from job to job within the Province of Alberta as required, select, hire, promote, discharge any employee for just cause only, reject applications for work, manage the business in all respects in accordance with his commitments and responsibilities and the right to determine methods, processes, means of application, handling and staffing of all jobs. The Employer shall have exclusive rights to decide and enforce all matters pertaining to the operation of his business, provided it does not conflict or discriminate against individual Union rights as agreed herein. Except as specifically modified by the terms of this Agreement the Employer reserves all of the historic or traditional rights of management.

The management of the operations of the Office of the Sheriff, the determination of its mission, policies, budget and operations, the manner of exercise of its statutory functions and the directions of its work force, including, but not limited to the right to hire, promote, and demote consistent with the provisions of the Agreement and the Merit Commission statutes, rules and regulations; to relieve employees from duty because of lack of work or other legitimate reasons; to determine the existence of such work shortage, to establish xxxxxxx requirements; to make and enforce reasonable job rules and job regulations and to enforce penalties for their violation; to evaluate employees; to determine the departments, divisions and sections and work to be performed therein; to determine the standards of professionalism required of the employees and, from time to time, to change those standards; to establish standards for equipment, uniforms, dress and grooming; to determine the shifts per work week and starting times of shifts; to establish and change work schedules and assignments; to assign overtime; to determine whether goods or services shall be made or purchased; to determine job content; to introduce new or improved methods of operation; and to maintain efficiency in the Office, is vested exclusively in the Employer, provided the exercise of such rights of management does not conflict with any of the express written provisions of this Agreement.
