New Material. The Contractor represents and warrants that the goods, materials, supplies, or components offered to the County under this contract are new, not used or reconditioned, and are not of such age or so deteriorated as to impair their usefulness or safety and that the goods, materials, supplies, or components offered are current production models of the respective manufacturer.
New Material. New Material transferred from the Manager or Member shall be priced F.O.B. the nearest reputable supply store or railway receiving point, where like Material is available, at the current replacement cost of the same kind of Material, exclusive of any available cash discounts, at the time of the transfer (herein called, “New Price”).

Seller warrants that none of the items furnished under this order are surplus, used, remanufactured, remarked, reconditioned or counterfeit or of such age or so deteriorated as to impair the usefulness or safety thereof, unless otherwise specifically stated on the face of this order. In order to prevent the acceptance and shipment of fraudulent and counterfeit materials, Seller must meet industry AS5553, AS6174 or equivalent standard. Seller shall immediately notify Buyer if Seller becomes aware or suspects that it has furnished fraudulent or counterfeit materials. Buyer shall not return or pay for any fraudulent or counterfeit materials but shall provide evidence of such to Seller.
New Material. Seller warrants that none of the articles furnished under this order are surplus, used, remanufactured or reconditioned or of such age or so deteriorated as to impair the usefulness or safety thereof, unless otherwise specifically stated on the face of this order. Unless otherwise provided on the face of this order, THE PRICES APPEARING HEREIN INCLUDE ALL PACKAGING, CRATING AND FEDERAL, STATE AND LOCAL TAXES, IF APPLICABLE, AND ARE FIRM FOR THE DELIVERY PERIOD SHOWN.
New Material. New Material (Condition “A”), being new Material procured for the Joint Property but never used, at one hundred per cent (100%) of current new price (plus sales tax if any).
New Material. “Material,” as used in this clause, includes, but is not limited to raw material, parts, items, components and end Items. “New,” as used in this clause, means previously unused or composed of previously unused materials allowing for typical in-factory or site use including, but not limited to integration, installation, assembly, test, burn-in, training, troubleshooting, and rework as required. Unless Buyer specifies in writing otherwise, Seller shall deliver New Material under this contract that are fully warranted and do not contain any counterfeit material. Material verification includes documentation that Seller is purchasing product directly from the original equipment manufacturer or authorized franchised distributor. In addition, the New Material is not of such age or so deteriorated, due to storage factors, as to impair its usefulness or safety.
New Material. New Material shall be priced on the basis of current market value plus expenses in moving such Material directly to the job-site where Material is used.
New Material. Unless otherwise provided in the specifications, all goods to be supplied to the City shall be from new, unused, current stock.
New Material. If new material becomes available during the process of consideration of a candidate for promotion and/or tenure, the candidate, Department Chairperson, Xxxx, or Library Director may add such material to the dossier at any time up to February 15 of the year in which the Board of Trustees acts on the recommendation. Any new material, including but not limited to recommendation letters and response letters from the candidate, added to the dossier will be provided concurrently to the candidate and to all levels that have already participated in the review and made a recommendation. The Promotion and Tenure Committee may choose to review its recommendation. The candidate will be given the opportunity to review and respond in writing to the material within ten (10) working days following the receipt of the new material. This response will become part of the dossier. No recommendation on promotion or tenure will be made at any level until the 10 days have expired or the candidate has responded or waived the right to response.
