Agreement to Remain Shipper. With respect to any Product that is transported, stored or loaded in connection with any of the Applicable Assets by HFRM, HFRM agrees that it will continue acting in the capacity of the shipper of any such Product for its own account at all times that such Product is being transported, stored, handled or loaded in the Applicable Assets.
Agreement to Remain Shipper. With respect to any Refined Product that is produced at a Refinery and transported in the Roswell Products Pipeline or Xxxxx Cross Pipelines or any Crude Oil that is acquired by the HollyFrontier Entities and transported on the Crude Oil Trunk Pipelines, Crude Oil Gathering Pipelines or Xxxxx Cross Pipelines and stored in the Artesia Crude Oil Pipeline Tankage or Lovington Crude Oil Pipeline Tankage, the HollyFrontier Entities agree that they will continue their historical commercial practice of owning such Crude Oil or Refined Product, as applicable, from such point as (i) the Refined Product leaves the Refinery until at least such point as it will not be further transported in the Roswell Products Pipeline or Xxxxx Cross Pipelines and to continue acting in the capacity of the shipper of such Refined Product for their own account at all times that such Refined Product is in the Roswell Products Pipeline or Xxxxx Cross Pipeline; and (ii) the Crude Oil is received into the Crude Oil Trunk Pipelines, Crude Oil Gathering Pipelines or Xxxxx Cross Pipelines by the Partnership Entities until such time that it is delivered to the Artesia Crude Oil Pipeline Tankage at the Artesia Refinery or delivered to the Lovington Crude Oil Pipeline Tankage at the Lovington Refinery.
Agreement to Remain Shipper. With respect to any Crude Oil or Products that are transported, stored or handled in connection with any of the El Dorado Assets, Frontier El Dorado agrees that Frontier El Dorado or another HollyFrontier Entity will continue acting in the capacity of the shipper of any such Crude Oil or Products for its own account at all times that such Crude Oil or Products are being transported, stored or handled in such El Dorado Assets.
Agreement to Remain Shipper. With respect to any Crude Oil or Products that are transported, stored or handled in connection with any of the Group 1 Assets or the Group 2 Assets, Xxxxx Tulsa agrees that it will continue acting in the capacity of the shipper of any such Crude Oil or Products for its own account at all times that such Crude Oil or Products are being transported, stored or handled in such Group 1 Assets or Group 2 Assets, as the case may be.
Agreement to Remain Shipper. With respect to any Products that are transported to and from the Facility by HFRM, HFRM agrees that it will act in the capacity of the shipper of record for any such Products for its own account at all times that such Products are being transported to and from the Facility.
Agreement to Remain Shipper. With respect to any Refined Products that are produced at the Refinery and transported in any Refined Product Pipeline or handled at any Refined Product Terminal, ALON agrees that it will continue its historical commercial practice of owning such Refined Products from such point as such Refined Products leave the Refinery until at least such point as they will not be further transported in a Refined Product Pipeline or handled at a Refined Product Terminal and to continue acting in the capacity of the shipper of any such Refined Products for its own account at all times that such Refined Products are in a Refined Product Pipeline or being handled at the Refined Product Terminals.

With respect to any Crude Oil or Products that are transported, stored or handled in connection with any of the Cheyenne Assets, Frontier Cheyenne agrees that Frontier Cheyenne or another HollyFrontier Entity will continue acting in the capacity of the shipper of any such Crude Oil or Products for its own account at all times that such Crude Oil or Products are being transported, stored or handled in such Cheyenne Assets.
