Covered Employee. Is a Covered Employee and continues to be covered by the EACA provisions. [Note: Under this Election, the Participant’s Contrary Election will remain in effect, but the Participant must receive the EACA annual notice.]

Covered Employee. The term “Covered Employee”means an executive officer of the Plan Sponsor or other Participating Company designated by the Plan Administrator to be a “Covered Employee”.
Covered Employee. A Covered Employee is a Participant who is subject to the EACA. The Employer in its Adoption Agreement will elect whether a Participant who makes a Contrary Election is a Covered Employee. A Covered Employee must receive the annual EACA notice even though the Participant’s Contrary Election remains in effect. In addition, a Covered Employee who revokes his/her Contrary Election or, subject to the Vendor’s operational capabilities, whose Contrary Election expires, is thereafter immediately subject to the EACA Automatic Deferral.

Xxxxxx Co., Inc.) and (d) any Disabled Employee. Notwithstanding the preceding provisions of this Section 1.1(16) or any other provision of the Plan to the contrary, (i) no Employee of Smart Force, LLC or of the Xxxxxx Products Group of X.X. Xxxxxx Co., Inc. employed at its Gainesville location (formerly the Xxxxxx Calorific Division of X.X. Xxxxxx Co., Inc.), whose Employment Commencement Date, Reemployment Commencement Date or date of transfer to such company or location occurs on or after May 1, 2007 shall be a “Covered Employee” under the Plan for any period of time on or after such Employment Commencement Date, Reemployment Commencement Date or date of transfer, (ii) no Employee of Smart Force, LLC or of the Xxxxxx Products Group of X.X. Xxxxxx Co., Inc. employed at its Gainesville location (formerly the Xxxxxx Calorific Division of X.X. Xxxxxx Co., Inc.), who made an irrevocable election, pursuant to the retirement choice provided by X.X. Xxxxxx Co., Inc. in 2007, to become eligible to participate in the X.X. Xxxxxx Co., Inc. Profit Sharing/401(k) Plan effective as of January 1, 2008, shall be a “Covered Employee” under the Plan for any period of time on or after January 1, 2008, and (iii) no Employee of the Seal Seat division of Lincoln Global, Inc. whose Employment Commencement Date, Reemployment Commencement Date or date of transfer to such company or location occurs on or after May 1, 2013 shall be a “Covered Employee” under the Plan for any period of time on or after such Employment Commencement Date, Reemployment Commencement Date or date of transfer.
