We ( do here by undertake to pay the amount due and payable under this guarantee without any demur merely on demand from the Nagar Xxxxx/Nagar Palika/Nagar Panchayat stating the amount claimed is due by way of loss or damage caused to or would be caused to or suffered by the Nagar Xxxxx/Nagar Palika/Nagar Panchayat, by reason of breach by the said contractor (s) of any of the terms or conditions contained in the said aggrements or by reasons of the contractor (s) failure to perform the said agreement, Any such demand made on the bank shall be conclusive as regards the amount due and payable by the bank under this Guarantee, Howere our liability under this Guarantee. shall be restricted to an amount not exceeding ........................................................
We ( further agree that the guarantee herein contained shall remain in full force and effect during the period that would be taken for the performance of said agreement and that it shall continue to be enforce able till all the dues o the Nagar Xxxxx/Nagar Palika/Nagar Panchayat under or by virtue of the said agreement have been fully paid and its claims satisfied or discharged or till the Commissioner/Chief Municipal Officer,. certified that the terms and conditions of the said agreement have been fully and property carried out by the said contractor (s) and terms and conditions of the said agreement have been fully and property carried out by the said contractor
We ( further agree with the Nagar Xxxxx/Nagar Palika/Nagar Panchayat that the Nagar Xxxxx/Nagar Palika/Nagar Panchayat shall have the fullest liberty without our consent and with out affecting in any manner our obligation here under to vary any of the terms and conditions of the said agreement or to extend time of performance by the said contractor (s) from time to time or to postpone for any time or for time to time any of the powers excerciseable by Nagar Xxxxx/Nagar Palika/Nagar Panchayat, against the said contractor (s) and to for bear or enforce any of the terms and conditions relating to the said agreement and we shall not be relieved from our liability by reasons of any such variations. or extension being granted to the said contractor (s) or for barnacle, act or commission on the part of the Nagar Xxxxx/Nagar Palika/Nagar Panchayat, or any indulgence by the Nagar Xxxxx/Nagar Palika/Nagar Panchayat, to the said contractor (s) or by any such matter or thing what so ever which under the lay relating to surities would but for this provision have effect of so relieving us.
We (. Bank also agree that the Bank’s liability under this guarantee shall not be affected by any change in the constitution of the Contractor / Supplier or dissolution or winding up of the business of the contractor/ supplier.
We ( further agree that the Guarantee herein contained shall (indicate the name of the Bank) remain in full force and effect during the period that would be taken for the performance of the said agreement, and it shall continue to be enforceable till all the dues of the BMHRC under or by virtue of the said agreement have been fully paid, and its claims satisfied or discharged, or till the Dy. Director (Engg. Services) on behalf of the BMHRC, certifies that the terms & conditions of the said agreement have been fully and properly carried out by the said contractor(s), and accordingly discharges this guarantee.
We (. Bank further agree with the Purchaser that the Purchaser shall have the fullest liberty without our consent and without affecting in any manner our obligations hereunder to vary any of the terms and conditions of the said order/or to extend time of performance by the Supplier from time to time or to postpone for any time to time any of the powers exercisable by the Purchaser against the Contractor/ Supplier and to forbear to enforce any of the terms and conditions relating to the order and we shall not be relieved from our liability by reason of any such variation or extension being granted to the Contractor/ Supplier or for any forbearance, act or omission on the part of the Purchaser or any indulgence by the Purchaser to the Contractor/Supplier or by any such matter or things whatsoever which under the law relating to sureties would have the effect of relieving us.
We (. Bank ..................................do hereby undertake to pay the amounts due and payable under this Guarantee without any demur, merely on a demand from the Buyer stating that the amount claimed is due by way if loss or damage caused to or would be caused to or suffered by the Buyer by reason of any breach by the said Party of any of the terms and conditions contained in the said Tender or by reason of Party’s failure to perform the said Tender. Any such demand made on the Bank shall be conclusive as regards the amount due and payable by the Bank under this Guarantee.
We ( county prosecutor) and (each law enforcement agency having patrol juris- diction) will each designate one or more persons to serve as a liaison to appropriate local and county school officials. (The county superintendent) and (the local superintendent of each school) will similarly designate one or more persons to serve as a liaison to the county prosecutor’s office and to the respective local law enforcement agency. The roles and functions of these liaisons are to: < facilitate communication and cooperation; < identify issues or problems that arise in the implementation of this Agreement and facilitate the resolution of any such problems; < act as the primary contact person between the schools and the affected law enforcement agencies; < act together in developing joint training and other cooperative efforts, includ- ing information exchanges and joint speaking engagements, and < coordinate drug and alcohol abuse intervention and prevention efforts.
We ( further agree that the Guarantee (Indicate the name of Bank) herein contained shall remain in full force and effect during the period that would be taken for the performance of the said/ agreement and that it shall continue to be enforceable till all the dues of the Company under or by virtue of the said Agreement have been fully paid and its claims satisfied or discharged or till ________________________ Office/department/Division of Bharat Heavy Electricals Limited certifies that the terms and conditions of the said Agreement have been fully and properly carried out by the said bidder(s) and accordingly discharges this guarantee. Unless a demand or claim under this guarantee is made on us in writing on or before the ___________________________________________ we shall be discharged from all the liability under this guarantee thereafter.
