On September 30, 2011, the U.S. Equal Employment Opportunity Commission (Commission or EEOC) filed this action against Defendants Texas Roadhouse, Inc., and its wholly-owned subsidiaries, Defendants Texas Roadhouse Holdings LLC and Texas Roadhouse Management Corp., alleging that Defendants have engaged in a pattern or practice of age discrimination by refusing to hire applicants age 40 and over (the protected age group or PAG) for front-of-the-house (FOH) positions at their Texas Roadhouse restaurants nationwide, in violation of the Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. SS 626(b) (the ADEA). Defendants deny these allegations and deny that they have committed any wrongdoing.
