"Agreement Area" means the Agreement Area identified in Schedule 1 and Schedule 2 of this agreement.

3.1 Subject to clause 3.2, this Agreement commences on the Execution Date.
3.2 Clause 5 and clause 6 commence on Registration.
3.3 This Agreement may be terminated by written agreement executed by each party.
Statements of the kind mentioned in ss. 24EB(1) or 24EBA(1) or (4)
5.1 On condition that the Trustee has given a Project Notice to the RNTBC, the parties consent to the doing of the Agreed Acts to the extent they are Future Acts subject to the terms and conditions contained in the Agreement.
5.6 To avoid any doubt, Subdivision P, Division 3, Part 2 of the NTA does not apply to the Agreed Acts.
“Agreed Acts” means the doing of any Activity permitted or contemplated to complete the Community Hall Extension including:-
(a) any survey activities, geotechnical investigations or clearing of any land within the Agreement Area;
(b) the grant of any permits or authorities including the approval of a Development Application;
(c) the upgrade, renovation and restoration of the community hall;
(d) the construction of an extension to the community hall;
(e) the ongoing operation, use, maintenance or repair of the community hall; and
(f) any other thing that is similar to anything in this list that is to be carried out within the Agreement Area and which is accurately specified in a Project Notice.
"Community Hall Extension" means all Activities necessary to renovate the existing Ugar community hall (including a new kitchen and connection to sewerage treatment plant), to extend the existing Ugar community hall to include a new office, a new storeroom, a new cleaner's room and to increase the hall size overall, and to fence the area where the community hall is situated being an area of about 784.4 square metres.
“Development Application” means an application for a Development Permit for:
(a) carrying out building work for the Community Hall Extension;
(b) carrying out plumbing work for the Community Hall Extension; or
(c) carrying out operational work for the Community Hall Extension as required by the SPA "SPA" means Sustainable Planning Act 2009.
"Trustee" means the Torres Strait Island Regional Council (ABN 15 292 645 165)
