Xxxxx Common Stock definition

Xxxxx Common Stock has the meaning given to it in the Merger Agreement.

Xxxxx Common Stock means, collectively, the class A common stock, $.01 par value and class B common stock, $.01 par value, of Xxxxx.

• The rights granted to the Shareholder and the obligations of Xxxxx pursuant to this Section 3 shall terminate on the date on which the Shareholder, together with his Affiliates, ceases, following the Effective Time, to beneficially own 4% or more of the outstanding shares of Xxxxx Common Stock.
