Nothing contained in this Article 11 shall establish a period of limitation for any warranty obligation under the Contract Documents (other than the Defective Work Warranty) or modify a statute of limitations or repose.

If the Additional Insured have not been included as an insured under the Commercial General Liability, Business Auto Liability, and Excess Umbrella Liability Insurance coverages required herein, Contractor waives all rights against each Additional Insured, for recovery of damages arising out of or incident to the Project Work, Warranty Work, and/or Repair Work.
The Service Work Warranty only applies to malfunctions that are reported to Administrator during the Coverage Period of the Service Plan.
Notwithstanding the foregoing and subject to Section 17.7.2.2, if any of the Work shall fail to satisfy Contractor’s Work Warranty or the Materials Warranty, and such failure endangers human health or property or materially and adversely affects the operation of the Project, Contractor shall correct the failure as soon as is reasonably practicable.
