WHT definition

WHT means the withholding tax due under the Kenyan Income Tax Act, 1973 (as amended by Act No. 1 of 2020 and Act No. 2 of 2020), on certain capital payments. For the purposes of Kenyan tax, any portion of a Project Payment to an Investor that is in excess of the Contribution is deemed to be ‘other’ interest, per the Kenyan Income Tax Act, 1973 (as amended by Act No. 1 of 2020 and Act Xx. 0 xx 0000), Xxxxx Xxxxxxxx, Xxxx X, Section 5(h)(iii).
